119 relating to the determination of fees, charges, and rates for
1210 certain benefits under Medicaid.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Section 32.028(c), Human Resources Code, is
1513 amended to read as follows:
16- (c) The fee, charge, or rate for other medical assistance:
17- (1) is the usual and customary fee, charge, or rate
18- that prevails in the community unless the payment is limited by
19- state or federal law; and
20- (2) excludes any fee, charge, or rate offered as part
21- of a monthly fee-based membership discount program.
14+ (c) The fee, charge, or rate for other medical assistance is
15+ the usual and customary fee, charge, or rate that prevails in the
16+ community unless the payment is limited by state or federal law. In
17+ determining the usual and customary fee, charge, or rate under this
18+ subsection, the commission shall exclude any fee, charge, or rate
19+ offered as part of a fee-based membership discount program.
2220 SECTION 2. If before implementing any provision of this Act
2321 a state agency determines that a waiver or authorization from a
2422 federal agency is necessary for implementation of that provision,
2523 the agency affected by the provision shall request the waiver or
2624 authorization and may delay implementing that provision until the
2725 waiver or authorization is granted.
2826 SECTION 3. This Act takes effect September 1, 2025.
