88 AN ACT
99 relating to granting charters to certain public and private
1010 institutions of higher education for open-enrollment charter
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Subchapter E, Chapter 12,
1414 Education Code, is amended to read as follows:
1515 SUBCHAPTER E. PUBLIC OR PRIVATE INSTITUTION OF HIGHER EDUCATION
1616 [COLLEGE OR UNIVERSITY OR JUNIOR COLLEGE] CHARTER SCHOOL
1717 SECTION 2. Section 12.151, Education Code, is amended to
1818 read as follows:
1919 Sec. 12.151. DEFINITIONS. In this subchapter, "institution
2020 of higher education" and "private or independent institution of
2121 higher education" ["public junior college" and "public senior
2222 college or university"] have the meanings assigned by Section
2323 61.003.
2424 SECTION 3. Section 12.152(a), Education Code, is amended to
2525 read as follows:
2626 (a) In accordance with this subchapter and Subchapter D, the
2727 commissioner may grant a charter on the application of:
2828 (1) an institution of higher education [a public
2929 senior college or university] for an open-enrollment charter school
3030 to operate on the campus of the institution of higher education
3131 [public senior college or university] or, subject to Subsection
3232 (b), at another location in any county in this state; or
3333 (2) a private or independent institution of higher
3434 education [public junior college] for an open-enrollment charter
3535 school to operate on the campus of the private or independent
3636 institution of higher education [public junior college] or in the
3737 same county in which the campus of the private or independent
3838 institution of higher education [public junior college] is located.
3939 SECTION 4. Section 12.154(a), Education Code, is amended to
4040 read as follows:
4141 (a) Notwithstanding Section 12.110(d), the commissioner may
4242 grant a charter under this subchapter to an institution of higher
4343 education or a private or independent institution of higher
4444 education [a public senior college or university] only if the
4545 following criteria are satisfied in the institution's [public
4646 senior college's or university's] application, as determined by the
4747 commissioner:
4848 (1) the [college or university] charter school's
4949 educational program must include innovative teaching methods;
5050 (2) the [college or university] charter school's
5151 educational program must be implemented under the direct
5252 supervision of a member of the teaching or research faculty of the
5353 institution of higher education or the private or independent
5454 institution of higher education [public senior college or
5555 university];
5656 (3) the faculty member supervising the [college or
5757 university] charter school's educational program must have
5858 substantial experience and expertise in education research,
5959 teacher education, classroom instruction, or educational
6060 administration;
6161 (4) the [college or university] charter school's
6262 educational program must be designed to meet specific goals
6363 described in the charter, including improving student performance
6464 or dropout recovery, and each aspect of the program must be directed
6565 toward the attainment of the goals;
6666 (5) the attainment of the [college or university]
6767 charter school's educational program goals must be measured using
6868 specific, objective standards set forth in the charter, including
6969 assessment methods and a time frame; and
7070 (6) the financial operations of the [college or
7171 university] charter school must be supervised by the business
7272 office of the institution of higher education or the private or
7373 independent institution of higher education [public senior college
7474 or university].
7575 SECTION 5. Section 12.155, Education Code, is amended to
7676 read as follows:
7777 Sec. 12.155. SCHOOL NAME. The name of a [college or
7878 university] charter school operated by an institution of higher
7979 education or a private or independent institution of higher
8080 education under this subchapter [junior college charter school]
8181 must include the name of the institution [public senior college or
8282 university or public junior college, as applicable, operating the
8383 school].
8484 SECTION 6. Section 12.156(a), Education Code, is amended to
8585 read as follows:
8686 (a) Except as otherwise provided by this subchapter,
8787 Subchapter D applies to a [college or university] charter school
8888 operated by an institution of higher education or private or
8989 independent institution of higher education under this subchapter
9090 [or junior college charter school] as though the [college or
9191 university] charter school [or junior college charter school, as
9292 applicable,] were granted a charter under that subchapter.
9393 SECTION 7. Section 12.154(b), Education Code, is repealed.
9494 SECTION 8. The changes in law made by this Act apply only to
9595 an application for a charter filed on or after the effective date of
9696 this Act. An application for a charter filed before the effective
9797 date of this Act is governed by the law in effect on the date the
9898 application was filed, and the former law is continued in effect for
9999 that purpose.
100100 SECTION 9. This Act takes effect immediately if it receives
101101 a vote of two-thirds of all the members elected to each house, as
102102 provided by Section 39, Article III, Texas Constitution. If this
103103 Act does not receive the vote necessary for immediate effect, this
104104 Act takes effect September 1, 2025.
