11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter D, Chapter 263, Local Government | |
13 | 13 | Code, is amended by adding Section 263.1521 to read as follows: | |
14 | 14 | Sec. 263.1521. DISPOSITION OF CERTAIN SENSITIVE MEDIA | |
15 | 15 | DEVICES. (a) In this section, "sensitive media device" means a | |
16 | 16 | data storage device that the commissioners court of a county | |
17 | 17 | determines the county has used to store data the maintenance or | |
18 | 18 | disclosure of which is regulated by state or federal law. | |
19 | 19 | (b) Notwithstanding Section 263.152, the commissioners | |
20 | 20 | court of a county may order the destruction of a sensitive media | |
21 | 21 | device: | |
22 | 22 | (1) that is salvage or surplus property; and | |
23 | 23 | (2) for which the commissioners court determines that | |
24 | 24 | the destruction of the sensitive media device is necessary to | |
25 | 25 | prevent inadvertent disclosure of information in connection with | |
26 | 26 | the disposal of the device. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
