| 9 | 9 | | relating to the waiver of certain examination requirements for |

| 10 | 10 | | certain applicants for an engineering license. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 1001.305, Occupations Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | Sec. 1001.305. WAIVER OF EXAMINATION REQUIREMENT. (a) The |
|---|
| 15 | 15 | | board by rule may waive all or part of the examination requirement |
|---|
| 16 | 16 | | for an applicant for the issuance or reissuance of a license under |
|---|
| 17 | 17 | | this chapter. The board may not waive the requirement unless the |
|---|
| 18 | 18 | | board first determines that: |
|---|
| 19 | 19 | | (1) the applicant possesses sufficient qualifications |
|---|
| 20 | 20 | | to justify the waiver; and |
|---|
| 21 | 21 | | (2) issuing or reissuing the license to the applicant |
|---|
| 22 | 22 | | does not pose a threat to the public health, safety, or welfare. |
|---|
| 23 | 23 | | (b) The board shall waive the fundamentals of engineering |
|---|
| 24 | 24 | | examination requirement for an applicant for the issuance or |
|---|
| 25 | 25 | | reissuance of a license under this chapter, regardless of whether |
|---|
| 26 | 26 | | the applicant has previously failed a fundamentals of engineering |
|---|
| 27 | 27 | | examination in this state or another jurisdiction, if: |
|---|
| 28 | 28 | | (1) the applicant has engaged in the active practice |
|---|
| 29 | 29 | | of engineering for at least 15 years; |
|---|
| 30 | 30 | | (2) the board determines that issuing or reissuing the |
|---|
| 31 | 31 | | license to the applicant does not pose a threat to the public |
|---|
| 32 | 32 | | health, safety, or welfare; |
|---|
| 33 | 33 | | (3) the applicant requests a waiver in writing at the |
|---|
| 34 | 34 | | time the application is filed; and |
|---|
| 35 | 35 | | (4) the applicant meets the educational requirement of |
|---|
| 36 | 36 | | Section 1001.302(a)(1). |
|---|
| 37 | 37 | | SECTION 2. Section 1001.305, Occupations Code, as amended |
|---|
| 38 | 38 | | by this Act, applies only to an application for an engineering |
|---|
| 39 | 39 | | license that is filed on or after the effective date of this Act. An |
|---|
| 40 | 40 | | application that was filed before the effective date of this Act is |
|---|
| 41 | 41 | | governed by the law in effect on the date the application was filed, |
|---|
| 42 | 42 | | and the former law is continued in effect for that purpose. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2025. |
