77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the waiver of certain examination requirements for
1010 certain applicants for an engineering license.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1001.305, Occupations Code, is amended
1313 to read as follows:
1414 Sec. 1001.305. WAIVER OF EXAMINATION REQUIREMENT. (a) The
1515 board by rule may waive all or part of the examination requirement
1616 for an applicant for the issuance or reissuance of a license under
1717 this chapter. The board may not waive the requirement unless the
1818 board first determines that:
1919 (1) the applicant possesses sufficient qualifications
2020 to justify the waiver; and
2121 (2) issuing or reissuing the license to the applicant
2222 does not pose a threat to the public health, safety, or welfare.
2323 (b) The board shall waive the fundamentals of engineering
2424 examination requirement for an applicant for the issuance or
2525 reissuance of a license under this chapter, regardless of whether
2626 the applicant has previously failed a fundamentals of engineering
2727 examination in this state or another jurisdiction, if:
2828 (1) the applicant has engaged in the active practice
2929 of engineering for at least 15 years;
3030 (2) the board determines that issuing or reissuing the
3131 license to the applicant does not pose a threat to the public
3232 health, safety, or welfare;
3333 (3) the applicant requests a waiver in writing at the
3434 time the application is filed; and
3535 (4) the applicant meets the educational requirement of
3636 Section 1001.302(a)(1).
3737 SECTION 2. Section 1001.305, Occupations Code, as amended
3838 by this Act, applies only to an application for an engineering
3939 license that is filed on or after the effective date of this Act. An
4040 application that was filed before the effective date of this Act is
4141 governed by the law in effect on the date the application was filed,
4242 and the former law is continued in effect for that purpose.
4343 SECTION 3. This Act takes effect September 1, 2025.
