1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

265265 "Flood pool" means the area adjacent to a reservoir that lies
266266 above the normal maximum operating level of the reservoir and that
267267 is subject to controlled inundation under the management of the
268268 United States Army Corps of Engineers.
269269 "Flood insurance rate map" means the most recent flood hazard
270270 map published by the Federal Emergency Management Agency under the
271271 National Flood Insurance Act of 1968 (42 U.S.C. Section 4001 et
272272 seq.).
273273 "Floodway" means an area that is identified on the flood
274274 insurance rate map as a regulatory floodway, which includes the
275275 channel of a river or other watercourse and the adjacent land areas
276276 that must be reserved for the discharge of a base flood, also
277277 referred to as a 100-year flood, without cumulatively increasing
278278 the water surface elevation more than a designated height.
279279 "Reservoir" means a water impoundment project operated by the
280280 United States Army Corps of Engineers that is intended to retain
281281 water or delay the runoff of water in a designated surface area of
282282 land.

343343 SECTION 2. Subchapter A, Chapter 5, Property Code, is
344344 amended by adding Section 5.0131 to read as follows:
345345 Sec. 5.0131. NOTICE OF GROUNDWATER AND SURFACE WATER
346346 RIGHTS. (a) This section applies only to the sale of a fee simple
347347 interest in residential real property located in this state
348348 comprising not more than one dwelling unit and land on which the
349349 dwelling is located.
350350 (b) A seller of residential real property to which this
351351 section applies shall provide the purchaser of the property with a
352352 written notice describing the groundwater and surface water rights
353353 conveyed with the property.
354354 (c) The Texas Real Estate Commission shall develop and
355355 publish the form for the written notice required under Subsection
356356 (b). The form must require the seller to disclose information
357357 concerning:
358358 (1) whether the conveyance of the property includes
359359 any groundwater rights;
360360 (2) whether the conveyance of the property includes
361361 any surface water rights;
362362 (3) whether there are any water wells located on the
363363 property; and
364364 (4) if the property is located in a groundwater
365365 conservation district or a subsidence district, the name and any
366366 relevant information concerning the applicable district.
367367 (d) The notice must be delivered by the seller on or before
368368 the effective date of an executory contract binding the purchaser
369369 to purchase the property. If a contract is entered without the
370370 seller providing the notice as required by this section, the
371371 purchaser may terminate the contract for any reason not later than
372372 the seventh day after the effective date of the receiving of the
373373 notice.
374374 (e) The appropriate use of forms published by the Texas Real
375375 Estate Commission under this section constitutes compliance with
376376 this section.
377377 SECTION 3. Section 5.008(b), Property Code, as amended by
378378 this Act, and Section 5.0131, Property Code, as added by this Act,
379379 apply only to a transfer of property that occurs on or after the
380380 effective date of this Act. A transfer of property that occurs
381381 before the effective date of this Act is governed by the law
382382 applicable to the transfer immediately before that date, and the
383383 former law is continued in effect for that purpose. For the
384384 purposes of this section, a transfer of property occurs before the
385385 effective date of this Act if the contract binding the purchaser to
386386 purchase the property is executed before that date.
