77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an exemption from the definition of abortion for
1010 treatment provided for a miscarriage.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 245.002(1), Health and Safety Code, is
1313 amended to read as follows:
1414 (1) "Abortion" means the act of using or prescribing
1515 an instrument, a drug, a medicine, or any other substance, device,
1616 or means with the intent to cause the death of an unborn child of a
1717 woman known to be pregnant. The term does not include birth control
1818 devices or oral contraceptives. An act is not an abortion if the
1919 act is done with the intent to:
2020 (A) save the life or preserve the health of an
2121 unborn child;
2222 (B) provide treatment for a miscarriage or
2323 suspected miscarriage, in accordance with the applicable standard
2424 of medical care and by any means a physician determines medically
2525 appropriate [remove a dead, unborn child whose death was caused by
2626 spontaneous abortion]; or
2727 (C) remove an ectopic pregnancy.
2828 SECTION 2. This Act takes effect September 1, 2025.
