9 | 9 | relating to an exemption from the definition of abortion for | |
10 | 10 | treatment provided for a miscarriage. | |
11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 245.002(1), Health and Safety Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (1) "Abortion" means the act of using or prescribing | |
15 | 15 | an instrument, a drug, a medicine, or any other substance, device, | |
16 | 16 | or means with the intent to cause the death of an unborn child of a | |
17 | 17 | woman known to be pregnant. The term does not include birth control | |
18 | 18 | devices or oral contraceptives. An act is not an abortion if the | |
19 | 19 | act is done with the intent to: | |
20 | 20 | (A) save the life or preserve the health of an | |
21 | 21 | unborn child; | |
22 | 22 | (B) provide treatment for a miscarriage or | |
23 | 23 | suspected miscarriage, in accordance with the applicable standard | |
24 | 24 | of medical care and by any means a physician determines medically | |
25 | 25 | appropriate [remove a dead, unborn child whose death was caused by | |
26 | 26 | spontaneous abortion]; or | |
27 | 27 | (C) remove an ectopic pregnancy. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
