77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of the attorney general to acquire by
1010 eminent domain certain real property owned by aliens or foreign
1111 entities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Title 4, Property Code, is amended by adding
1414 Chapter 21A to read as follows:
1515 CHAPTER 21A. ACQUISITION BY EMINENT DOMAIN OF CERTAIN
1616 FOREIGN-OWNED REAL PROPERTY
1717 Sec. 21A.001. DEFINITIONS. In this chapter:
1818 (1) "Alien" means a citizen of a country other than the
1919 United States.
2020 (2) "Critical infrastructure" means infrastructure in
2121 one of the following categories:
2222 (A) chemical;
2323 (B) commercial facilities;
2424 (C) communications;
2525 (D) critical manufacturing;
2626 (E) dams;
2727 (F) defense industrial bases;
2828 (G) emergency services;
2929 (H) energy;
3030 (I) financial services;
3131 (J) food and agriculture;
3232 (K) government facilities;
3333 (L) health care and public health;
3434 (M) information technology;
3535 (N) nuclear reactors, materials, and waste;
3636 (O) transportation systems; or
3737 (P) water and wastewater systems.
3838 (3) "Foreign" means created or organized in a country
3939 other than the United States or under the law of a country other
4040 than the United States.
4141 Sec. 21A.002. APPLICABILITY. This chapter applies to real
4242 property in this state owned by an alien, foreign business, or
4343 foreign government, or an agent, trustee, or fiduciary of an alien,
4444 foreign business, or foreign government.
4545 Sec. 21A.003. EMINENT DOMAIN; COURT PROCEEDING. (a) The
4646 attorney general may bring an action to obtain a court order under
4747 Subsection (c) authorizing the attorney general to initiate an
4848 eminent domain proceeding to acquire real property owned by an
4949 alien or foreign entity as described by Section 21A.002 if the
5050 attorney general has reason to believe and shows the real property
5151 is being used in a manner that:
5252 (1) violates state or federal law; or
5353 (2) creates a risk to the state's critical
5454 infrastructure.
5555 (b) An action under this section may be brought in a
5656 district court in the county where all or part of the real property
5757 that is the subject of the action is located.
5858 (c) If the district court finds the attorney general has
5959 made the showing required by Subsection (a), the court shall enter
6060 an order stating that finding.
6161 (d) On entry of the district court's order under Subsection
6262 (c), the attorney general may initiate eminent domain proceedings
6363 to acquire the real property.
6464 (e) Chapter 21 governs the procedure for an eminent domain
6565 proceeding initiated in accordance with this chapter. Chapter 2206,
6666 Government Code, and Subchapter E, Chapter 21, of this code do not
6767 apply to an eminent domain proceeding initiated in accordance with
6868 this chapter.
6969 Sec. 21A.004. STATE MANAGEMENT OF ACQUIRED REAL PROPERTY.
7070 Real property acquired by eminent domain under Section 21A.003
7171 shall be owned by this state and managed by the General Land Office.
7272 SECTION 2. As soon as practicable after the effective date
7373 of this Act, the attorney general shall adopt rules for the
7474 implementation of Chapter 21A, Property Code, as added by this Act.
7575 SECTION 3. This Act takes effect September 1, 2025.
