7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the operations and administration of the Concho County
10	10	Hospital District.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 1016.053, Special District Local Laws
13	13	Code, is amended to read as follows:
14	14	Sec. 1016.053. BALLOT APPLICATION [PETITION]. A person who
15	15	wants to have the person's name printed on the ballot as a candidate
16	16	for director must file an application with the board secretary in
17	17	accordance with Chapter 144, Election Code [a petition requesting
18	18	that action. The petition must be:
19	19	[(1) signed by at least 10 registered taxpaying
20	20	voters; and
21	21	[(2) filed by the deadline imposed by Section 144.005,
22	22	Election Code].
23	23	SECTION 2. Section 1016.054, Special District Local Laws
24	24	Code, is amended to read as follows:
25	25	Sec. 1016.054. QUALIFICATIONS FOR OFFICE. (a) A person may
26	26	not be elected or appointed as a director unless the person is:
27	27	(1) a district resident; and
28	28	(2) a qualified voter[;
29	29	[(3) a freeholder; and
30	30	[(4) at least 18 years of age when elected or
31	31	appointed].
32	32	(b) A person may not be elected or appointed as a director if
33	33	the person is a district employee.
34	34	SECTION 3. Section 1016.057, Special District Local Laws
35	35	Code, is amended to read as follows:
36	36	Sec. 1016.057. OFFICERS. The board shall elect a
37	37	president, a vice president, and a secretary from among its
38	38	members.
39	39	SECTION 4. The heading to Section 1016.060, Special
40	40	District Local Laws Code, is amended to read as follows:
41	41	Sec. 1016.060. DISTRICT ADMINISTRATOR[; ASSISTANT
42	42	ADMINISTRATOR].
43	43	SECTION 5. Section 1016.060(c), Special District Local Laws
44	44	Code, is amended to read as follows:
45	45	(c) The district administrator serves [and any assistant
46	46	administrator serve] at the will of the board and is [are] entitled
47	47	to the compensation determined by the board.
48	48	SECTION 6. Section 1016.110, Special District Local Laws
49	49	Code, is amended to read as follows:
50	50	Sec. 1016.110. CONSTRUCTION [OR PURCHASE] CONTRACTS. (a)
51	51	The board may enter into construction contracts for the district.
52	52	(b) The board may enter into a public work contract as
53	53	authorized under Chapter 2269, Government Code.
54	54	(c) Chapter 2253, Government Code, as it relates to
55	55	performance and payment bonds, applies to the district's
56	56	construction contracts [A construction or purchase contract that
57	57	involves the expenditure of more than $2,000 may be made only after
58	58	advertising in the manner provided by Chapter 252 and Subchapter C,
59	59	Chapter 262, Local Government Code].
60	60	SECTION 7. Section 1016.160(a), Special District Local Laws
61	61	Code, is amended to read as follows:
62	62	(a) Except as otherwise provided by Section 1016.107(c) of
63	63	this code, Section 315.002, Health and Safety Code, this
64	64	subchapter, and Subchapter E of this chapter, the district may not
65	65	incur a debt [an obligation] payable from district revenue other
66	66	than the revenue on hand or to be on hand in the current and
67	67	following district fiscal years.
68	68	SECTION 8. The following provisions of the Special District
69	69	Local Laws Code are repealed:
70	70	(1) Section 1016.055; and
71	71	(2) Sections 1016.060(b) and (d).
72	72	SECTION 9. (a) The changes in law made by this Act to
73	73	Section 1016.053, Special District Local Laws Code, apply only to
74	74	an election ordered on or after the effective date of this Act.
75	75	(b) The changes in law made by this Act to Section 1016.054,
76	76	Special District Local Laws Code:
77	77	(1) do not affect the entitlement of a director
78	78	serving on the board of directors immediately before the effective
79	79	date of this Act to continue to serve on the board for the remainder
80	80	of the director's term;
81	81	(2) apply only to a member of the board of directors
82	82	elected or appointed to the board on or after the effective date of
83	83	this Act; and
84	84	(3) do not prohibit a director serving on the board of
85	85	directors on the effective date of this Act from being reelected or
86	86	reappointed to the board if the director has the qualifications
87	87	required for membership on the board under Section 1016.054,
88	88	Special District Local Laws Code, as amended by this Act.
89	89	SECTION 10. This Act takes effect immediately if it
90	90	receives a vote of two-thirds of all the members elected to each
91	91	house, as provided by Section 39, Article III, Texas Constitution.
92	92	If this Act does not receive the vote necessary for immediate
93	93	effect, this Act takes effect September 1, 2025.
