77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of the criminal offense of harmful
1010 communication to a minor.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 43, Penal Code, is amended
1313 by adding Section 43.245 to read as follows:
1414 Sec. 43.245. HARMFUL COMMUNICATION TO MINOR. (a) In this
1515 section:
1616 (1) "Communication" means any verbal or written
1717 communication.
1818 (2) "Minor" means an individual younger than 18 years
1919 of age.
2020 (3) "Sexual conduct" has the meaning assigned by
2121 Section 43.25.
2222 (4) "Sexual excitement" means male or female human
2323 genitals in a state of sexual stimulation or arousal.
2424 (b) A person who is 18 years of age or older commits an
2525 offense if:
2626 (1) the person communicates to a minor explicit and
2727 detailed descriptions or narrative accounts of sexual conduct,
2828 sexual excitement, physical torture, or brutality;
2929 (2) the person knows or reasonably should know that
3030 the individual to whom the communication is made is a minor; and
3131 (3) the communication is harmful to minors.
3232 (c) For purposes of Subsection (b)(3), a communication is
3333 harmful to minors if the dominant theme of the communication taken
3434 as a whole:
3535 (1) appeals to the prurient interest of a minor, in
3636 sex, nudity, or excretion;
3737 (2) is patently offensive to prevailing standards in
3838 the adult community as a whole with respect to what is suitable for
3939 minors; and
4040 (3) is utterly without redeeming social value for
4141 minors.
4242 (d) The affirmative defenses provided by Section 22.011(e)
4343 also apply to a prosecution under this section.
4444 (e) An offense under this section is a Class A misdemeanor.
4545 (f) If conduct that constitutes an offense under this
4646 section also constitutes an offense under any other law, the actor
4747 may be prosecuted under this section, the other law, or both.
4848 SECTION 2. This Act takes effect September 1, 2025.
