77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a defense to prosecution for the offense of aggravated
1010 assault.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 22.02, Penal Code, is amended by adding
1313 Subsection (a-1) to read as follows:
1414 (a-1) It is a defense to prosecution under Subsection (a)(2)
1515 that the actor threatened to cause death or serious bodily injury by
1616 exhibiting a deadly weapon if:
1717 (1) the actor's threat would be justified under
1818 Chapter 9; and
1919 (2) the actor reasonably believed that creating an
2020 apprehension that the actor would use the deadly weapon was
2121 immediately necessary to defend the actor against another's use or
2222 attempted use of unlawful force or deadly force.
2323 SECTION 2. The change in law made by this Act applies only
2424 to an offense committed on or after the effective date of this Act.
2525 An offense committed before the effective date of this Act is
2626 governed by the law in effect on the date the offense was committed,
2727 and the former law is continued in effect for that purpose. For
2828 purposes of this section, an offense was committed before the
2929 effective date of this Act if any element of the offense was
3030 committed before that date.
3131 SECTION 3. This Act takes effect September 1, 2025.
