88 AN ACT
99 relating to the authority of a municipality to regulate a
1010 home-based business.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 229, Local Government
1313 Code, is amended by adding Section 229.902 to read as follows:
1414 Sec. 229.902. AUTHORITY TO REGULATE HOME-BASED BUSINESSES.
1515 (a) In this section:
1616 (1) "Business" has the meaning assigned by Section
1717 1.002, Business Organizations Code.
1818 (2) "Home-based business" means a business that is
1919 operated:
2020 (A) from a residential property;
2121 (B) by the owner or tenant of the property; and
2222 (C) for the purpose of:
2323 (i) manufacturing, providing, or selling a
2424 lawful good; or
2525 (ii) providing a lawful service.
2626 (3) "No-impact home-based business" means a
2727 home-based business that:
2828 (A) has at any time on the property where the
2929 business is operated a total number of employees and clients or
3030 patrons of the business that does not exceed the municipal
3131 occupancy limit for the property;
3232 (B) does not generate on-street parking or a
3333 substantial increase in traffic through the area; and
3434 (C) operates in a manner in which none of its
3535 activities are visible from a street.
3636 (b) The governing body of a municipality may not adopt or
3737 enforce an ordinance, regulation, or other measure that:
3838 (1) prohibits the operation of a no-impact home-based
3939 business;
4040 (2) requires a person that operates a no-impact
4141 home-based business or that owns the property where the business is
4242 operated to obtain a license, permit, or other approval to operate
4343 the business; or
4444 (3) requires a person that operates a home-based
4545 business or that owns the property where the business is operated
4646 to:
4747 (A) rezone the property for a non-residential
4848 use; or
4949 (B) install a fire sprinkler protection system if
5050 the residence where the business is operated consists only of:
5151 (i) a single-family detached residential
5252 structure; or
5353 (ii) a multi-family residential structure
5454 with not more than two residential units.
5555 (c) Subject to Subsection (b), the governing body of a
5656 municipality may:
5757 (1) require that a home-based business be:
5858 (A) in compliance with federal, state, and local
5959 law, including:
6060 (i) a municipal fire and building code; and
6161 (ii) a municipal regulation related to:
6262 (a) health and sanitation;
6363 (b) transportation or traffic
6464 control;
6565 (c) solid or hazardous waste; or
6666 (d) pollution and noise control;
6767 (B) compatible with the residential use of the
6868 property where the business is located; and
6969 (C) secondary to the use of the property as a
7070 residential dwelling; and
7171 (2) limit or prohibit the operation of a home-based
7272 business that:
7373 (A) sells alcohol or illegal drugs;
7474 (B) is a structured sober living home; or
7575 (C) is a sexually oriented business as defined by
7676 Section 243.002.
7777 (d) This section does not prohibit a person from enforcing a
7878 rule or deed restriction imposed by a homeowners' association or by
7979 other private agreement.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2025.
