9 | 9 | | relating to a study regarding the education and retention of |

10 | 10 | | obstetricians and gynecologists in this state. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter C, Chapter 61, Education Code, is |
---|
13 | 13 | | amended by adding Section 61.06697 to read as follows: |
---|
14 | 14 | | Sec. 61.06697. STUDY ON EDUCATION AND RETENTION OF |
---|
15 | 15 | | OBSTETRICIANS AND GYNECOLOGISTS IN THIS STATE. (a) The board, in |
---|
16 | 16 | | collaboration with the Texas Workforce Commission, shall conduct a |
---|
17 | 17 | | study on the availability and adequacy of obstetrical and |
---|
18 | 18 | | gynecological education and on the state retention of obstetrical |
---|
19 | 19 | | and gynecological students graduating from a medical school in this |
---|
20 | 20 | | state and of other obstetricians and gynecologists practicing in |
---|
21 | 21 | | this state. |
---|
22 | 22 | | (b) The study must: |
---|
23 | 23 | | (1) assess the availability and adequacy of |
---|
24 | 24 | | obstetrical and gynecological coursework and residency |
---|
25 | 25 | | opportunities in this state, including residency opportunities |
---|
26 | 26 | | provided by teaching hospitals; |
---|
27 | 27 | | (2) for each of the preceding 10 years, identify the |
---|
28 | 28 | | number of: |
---|
29 | 29 | | (A) obstetricians and gynecologists receiving |
---|
30 | 30 | | medical degrees in this state who, after the first anniversary of |
---|
31 | 31 | | receiving those degrees, were still practicing obstetrics and |
---|
32 | 32 | | gynecology in this state; and |
---|
33 | 33 | | (B) obstetricians and gynecologists who moved |
---|
34 | 34 | | their medical practice from this state to another state, regardless |
---|
35 | 35 | | of when they were licensed and regardless of whether their medical |
---|
36 | 36 | | degrees were awarded in this state; |
---|
37 | 37 | | (3) compare the student enrollment in obstetrical and |
---|
38 | 38 | | gynecological coursework before and following the issuance of the |
---|
39 | 39 | | United States Supreme Court judgment in Dobbs v. Jackson Women's |
---|
40 | 40 | | Health Organization, 597 U.S. 215 (2022) and Section 6, Chapter 62 , 597 U.S. 215 (2022) and Section 6, Chapter 62 |
---|
41 | 41 | | (S.B. 8), Acts of the 87th Legislature, Regular Session, 2021; and |
---|
42 | 42 | | (4) assess the ability of the obstetrical and |
---|
43 | 43 | | gynecological workforce to meet the need for health care services |
---|
44 | 44 | | in this state. |
---|
45 | 45 | | (c) Not later than December 1, 2026, the board shall submit |
---|
46 | 46 | | to the governor, the lieutenant governor, the speaker of the house |
---|
47 | 47 | | of representatives, and the presiding officer of each standing |
---|
48 | 48 | | legislative committee having primary jurisdiction over higher |
---|
49 | 49 | | education a report on the results of the study and any |
---|
50 | 50 | | recommendations for legislative or other action. |
---|
51 | 51 | | (d) This section expires January 1, 2028. |
---|
52 | 52 | | SECTION 2. This Act takes effect immediately if it receives |
---|
53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
---|
54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
---|
56 | 56 | | Act takes effect September 1, 2025. |
