77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study regarding the education and retention of
1010 obstetricians and gynecologists in this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1313 amended by adding Section 61.06697 to read as follows:
1414 Sec. 61.06697. STUDY ON EDUCATION AND RETENTION OF
1515 OBSTETRICIANS AND GYNECOLOGISTS IN THIS STATE. (a) The board, in
1616 collaboration with the Texas Workforce Commission, shall conduct a
1717 study on the availability and adequacy of obstetrical and
1818 gynecological education and on the state retention of obstetrical
1919 and gynecological students graduating from a medical school in this
2020 state and of other obstetricians and gynecologists practicing in
2121 this state.
2222 (b) The study must:
2323 (1) assess the availability and adequacy of
2424 obstetrical and gynecological coursework and residency
2525 opportunities in this state, including residency opportunities
2626 provided by teaching hospitals;
2727 (2) for each of the preceding 10 years, identify the
2828 number of:
2929 (A) obstetricians and gynecologists receiving
3030 medical degrees in this state who, after the first anniversary of
3131 receiving those degrees, were still practicing obstetrics and
3232 gynecology in this state; and
3333 (B) obstetricians and gynecologists who moved
3434 their medical practice from this state to another state, regardless
3535 of when they were licensed and regardless of whether their medical
3636 degrees were awarded in this state;
3737 (3) compare the student enrollment in obstetrical and
3838 gynecological coursework before and following the issuance of the
3939 United States Supreme Court judgment in Dobbs v. Jackson Women's
4040 Health Organization, 597 U.S. 215 (2022) and Section 6, Chapter 62 , 597 U.S. 215 (2022) and Section 6, Chapter 62
4141 (S.B. 8), Acts of the 87th Legislature, Regular Session, 2021; and
4242 (4) assess the ability of the obstetrical and
4343 gynecological workforce to meet the need for health care services
4444 in this state.
4545 (c) Not later than December 1, 2026, the board shall submit
4646 to the governor, the lieutenant governor, the speaker of the house
4747 of representatives, and the presiding officer of each standing
4848 legislative committee having primary jurisdiction over higher
4949 education a report on the results of the study and any
5050 recommendations for legislative or other action.
5151 (d) This section expires January 1, 2028.
5252 SECTION 2. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2025.
