| 11 | 11 | | Commission or the Parks and Wildlife Department. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 12, Parks and Wildlife |
|---|
| 14 | 14 | | Code, is amended by adding Section 12.029 to read as follows: |
|---|
| 15 | 15 | | Sec. 12.029. CHRONIC WASTING DISEASE CONTAINMENT ZONES AND |
|---|
| 16 | 16 | | SURVEILLANCE ZONES PROHIBITED. (a) In this section: |
|---|
| 17 | 17 | | (1) "Chronic wasting disease containment zone" means a |
|---|
| 18 | 18 | | geographic area defined by the commission or the department where: |
|---|
| 19 | 19 | | (A) chronic wasting disease is detected; or |
|---|
| 20 | 20 | | (B) using the best available science and data, |
|---|
| 21 | 21 | | the commission or the department determines chronic wasting disease |
|---|
| 22 | 22 | | detection is probable. |
|---|
| 23 | 23 | | (2) "Chronic wasting disease surveillance zone" means |
|---|
| 24 | 24 | | a geographic area defined by the commission or the department |
|---|
| 25 | 25 | | where, using the best available science and data, the commission or |
|---|
| 26 | 26 | | the department determines the presence of chronic wasting disease |
|---|
| 27 | 27 | | could reasonably be expected. |
|---|
| 28 | 28 | | (b) The commission or the department may not: |
|---|
| 29 | 29 | | (1) designate or maintain a designation for a |
|---|
| 30 | 30 | | geographic area as a chronic wasting disease containment zone or |
|---|
| 31 | 31 | | surveillance zone; or |
|---|
| 32 | 32 | | (2) otherwise designate or maintain a designation for |
|---|
| 33 | 33 | | a geographic area in a manner that regulates the activities in the |
|---|
| 34 | 34 | | geographic area of the holder of a license or permit issued under |
|---|
| 35 | 35 | | this code based on the detection or expected presence of chronic |
|---|
| 36 | 36 | | wasting disease in that area. |
|---|
| 37 | 37 | | SECTION 2. On the effective date of this Act, a chronic |
|---|
| 38 | 38 | | wasting disease containment zone or surveillance zone, as defined |
|---|
| 39 | 39 | | by Section 12.029, Parks and Wildlife Code, as added by this Act, |
|---|
| 40 | 40 | | that was established before the effective date of this Act is |
|---|
| 41 | 41 | | abolished. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2025. |
