79 relating to certain files maintained by a law enforcement agency
810 regarding certain employees of the agency.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter J, Chapter 1701, Occupations Code, is
1113 amended by adding Section 1701.45351 to read as follows:
1214 Sec. 1701.45351. DEPARTMENT FILE. (a) In this section,
1315 "department file" means a file maintained by a law enforcement
1416 agency for each license holder employed by the agency for the
1517 agency's use.
1618 (b) The head of a law enforcement agency or the head's
1719 designee shall maintain a department file on each license holder
1820 employed by the agency.
1921 (c) A department file must contain any letter, memorandum,
2022 or document relating to the license holder not included in a
2123 personnel file maintained under a policy adopted under Section
2224 1701.4535, including any letter, memorandum, or document relating
2325 to alleged misconduct by the license holder for which the agency
2426 determines there is insufficient evidence to sustain the charge of
2527 misconduct.
2628 (d) As provided by Section 1701.451, a law enforcement
2729 agency hiring a license holder is entitled to view the contents of
2830 the license holder's department file.
2931 (e) A law enforcement agency shall provide contents from a
3032 license holder's department file to the commission in accordance
3133 with:
3234 (1) Section 1701.4522(b)(1)(D); or
3335 (2) a request by the commission as part of an ongoing
3436 investigation relating to the license holder.
3537 (f) Except as provided by Subsections (d) and (e), a law
3638 enforcement agency may not release any information contained in a
3739 license holder's department file to any other agency or person
3840 requesting information relating to the license holder. The agency
3941 shall refer the person or agency requesting the information to the
4042 agency head or the head's designee. A department file maintained
4143 under this section is confidential and not subject to disclosure
4244 under Chapter 552, Government Code.
4345 SECTION 2. This Act takes effect September 1, 2025.
