77 AN ACT
88 relating to the regulation of certain eviction-related service
99 businesses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter E, Chapter 17, Business & Commerce
1212 Code, is amended by adding Section 17.465 to read as follows:
1313 Sec. 17.465. EVICTION-RELATED SERVICES. (a) In this
1414 section, "eviction-related services" means any service provided to
1515 consumers in connection with eviction suits filed by landlords
1616 under Chapter 24, Property Code, or with respect to prospective
1717 suits under that chapter.
1818 (b) For purposes of Section 17.46(a), the term "false,
1919 misleading, or deceptive acts or practices" includes the offering
2020 or provision of eviction-related services by a person who:
2121 (1) does not provide:
2222 (A) a clear, written disclosure to a consumer
2323 that includes:
2424 (i) a statement informing the consumer of
2525 the right to obtain legal aid services at no cost;
2626 (ii) a detailed description of the
2727 eviction-related services the person offers;
2828 (iii) information on tenant rights,
2929 including the importance of attending civil proceedings or hearings
3030 in relation to an eviction suit; and
3131 (iv) a notice that the eviction-related
3232 services offered may be accessed through nonprofit organizations
3333 for free; or
3434 (B) a clear statement in any advertisement or
3535 promotional material that the service is a private business and not
3636 affiliated with:
3737 (i) a federal, state, or local government
3838 entity; or
3939 (ii) a legal aid society or legal services
4040 program; or
4141 (2) instructs a consumer not to attend a civil
4242 proceeding or hearing in relation to an eviction suit filed by a
4343 landlord against the consumer under Chapter 24, Property Code, or
4444 with respect to a prospective suit under that chapter.
4545 (c) This section does not apply to:
4646 (1) a federal, state, or local government entity; or
4747 (2) a legal aid society or legal services program.
4848 (d) A violation of this section is a false, misleading, or
4949 deceptive act or practice under this subchapter, and any public or
5050 private right or remedy prescribed by this subchapter may be used to
5151 enforce this section.
5252 SECTION 2. Section 17.49(c), Business & Commerce Code, is
5353 amended to read as follows:
5454 (c) Nothing in this subchapter shall apply to a claim for
5555 damages based on the rendering of a professional service, the
5656 essence of which is the providing of advice, judgment, opinion, or
5757 similar professional skill. This exemption does not apply to:
5858 (1) an express misrepresentation of a material fact
5959 that cannot be characterized as advice, judgment, or opinion;
6060 (2) a failure to disclose information in violation of
6161 Section 17.46(b)(24) or Section 17.465(b);
6262 (3) an unconscionable action or course of action that
6363 cannot be characterized as advice, judgment, or opinion;
6464 (4) breach of an express warranty that cannot be
6565 characterized as advice, judgment, or opinion; or
6666 (5) a violation of Section 17.46(b)(26).
6767 SECTION 3. This Act takes effect September 1, 2025.
