11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 207.003(c), Property Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | (c) A property owners' association may charge a reasonable | |
15 | 15 | and necessary fee, not to exceed $375, to assemble, copy, and | |
16 | 16 | deliver the information required by this section and may charge a | |
17 | 17 | reasonable and necessary fee, not to exceed $75, to prepare and | |
18 | 18 | deliver an update of a resale certificate under Subsection (f). A | |
19 | 19 | property owners' association may not charge any other fee in | |
20 | 20 | connection with preparing or delivering a resale certificate or | |
21 | 21 | update of a resale certificate as required by this section, | |
22 | 22 | including a fee for an inspection or other activity performed by the | |
23 | 23 | association in connection with acquiring or updating the | |
24 | 24 | information contained in the resale certificate. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2025. |
