77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to assisted living facility operations and provision of
1010 certain services to assisted living facility residents without a
1111 license; creating a criminal offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 142, Health and Safety
1414 Code, is amended by adding Section 142.00605 to read as follows:
1515 Sec. 142.00605. PERSONAL ASSISTANCE SERVICES PROVIDED
1616 WITHOUT LICENSE TO CERTAIN INDIVIDUALS; CRIMINAL OFFENSE. (a) A
1717 person commits an offense if the person:
1818 (1) is required to hold a license under this chapter;
1919 and
2020 (2) provides without holding the required license
2121 personal assistance services to a resident of an assisted living
2222 facility, as defined by Section 247.002.
2323 (b) An offense under this section is a Class A misdemeanor,
2424 except the offense is a felony of the third degree if the person has
2525 been previously convicted of an offense under this section.
2626 SECTION 2. Subchapter C, Chapter 247, Health and Safety
2727 Code, is amended by adding Section 247.0441 to read as follows:
2828 Sec. 247.0441. LICENSE REQUIRED; CRIMINAL PENALTY. (a) A
2929 person commits an offense if the person operates an assisted living
3030 facility without holding a license issued under this chapter.
3131 (b) An offense under this section is a Class A misdemeanor,
3232 except the offense is a felony of the third degree if the person has
3333 been previously convicted of an offense under this section.
3434 SECTION 3. This Act takes effect September 1, 2025.
