| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter A, Chapter 142, Health and Safety |
|---|
| 14 | 14 | | Code, is amended by adding Section 142.00605 to read as follows: |
|---|
| 15 | 15 | | Sec. 142.00605. PERSONAL ASSISTANCE SERVICES PROVIDED |
|---|
| 16 | 16 | | WITHOUT LICENSE TO CERTAIN INDIVIDUALS; CRIMINAL OFFENSE. (a) A |
|---|
| 17 | 17 | | person commits an offense if the person: |
|---|
| 18 | 18 | | (1) is required to hold a license under this chapter; |
|---|
| 19 | 19 | | and |
|---|
| 20 | 20 | | (2) provides without holding the required license |
|---|
| 21 | 21 | | personal assistance services to a resident of an assisted living |
|---|
| 22 | 22 | | facility, as defined by Section 247.002. |
|---|
| 23 | 23 | | (b) An offense under this section is a Class A misdemeanor, |
|---|
| 24 | 24 | | except the offense is a felony of the third degree if the person has |
|---|
| 25 | 25 | | been previously convicted of an offense under this section. |

| 26 | 26 | | SECTION 2. Subchapter C, Chapter 247, Health and Safety |
|---|
| 27 | 27 | | Code, is amended by adding Section 247.0441 to read as follows: |
|---|
| 28 | 28 | | Sec. 247.0441. LICENSE REQUIRED; CRIMINAL PENALTY. (a) A |
|---|
| 29 | 29 | | person commits an offense if the person operates an assisted living |
|---|
| 30 | 30 | | facility without holding a license issued under this chapter. |
|---|
| 31 | 31 | | (b) An offense under this section is a Class A misdemeanor, |
|---|
| 32 | 32 | | except the offense is a felony of the third degree if the person has |
|---|
| 33 | 33 | | been previously convicted of an offense under this section. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
