| 8 | 8 | | relating to release of an area from a municipality's |

| 9 | 9 | | extraterritorial jurisdiction by petition or election. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 42.101, Local Government Code, is |
|---|
| 12 | 12 | | amended by amending Subdivisions (1), (4), and (5) and adding |
|---|
| 13 | 13 | | Subdivision (6) to read as follows: |
|---|
| 14 | 14 | | (1) within [five] fifteen miles of the boundary of a |
|---|
| 15 | 15 | | military base, as defined by Section 43.0117, at which an active |
|---|
| 16 | 16 | | training program is conducted; |
|---|
| 17 | 17 | | (4) in an area designated as an industrial district |
|---|
| 18 | 18 | | under Subsection 42.044; [or] |
|---|
| 19 | 19 | | (5) in an area subject to a strategic partnership |
|---|
| 20 | 20 | | agreement entered into under Section 43.0751, or any other |
|---|
| 21 | 21 | | agreement, including a development agreement entered into under |
|---|
| 22 | 22 | | Section 212.172; or [.] |
|---|
| 23 | 23 | | (6) in an area within a municipality’s certificate of |
|---|
| 24 | 24 | | convenience and necessity issued in accordance with Chapter 13, |
|---|
| 25 | 25 | | Subchapter G, Water Code. |
|---|
| 26 | 26 | | SECTION 2. Section 42.151, Local Government Code, is |
|---|
| 27 | 27 | | amended by amending Subdivisions (1), (4), and (5) and adding |
|---|
| 28 | 28 | | Subdivision (6) to read as follows: |
|---|
| 29 | 29 | | (1) within [five] fifteen miles of the boundary of a |

| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2025. |
