66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to release of an area from a municipality's
99 extraterritorial jurisdiction by petition or election.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.101, Local Government Code, is
1212 amended by amending Subdivisions (1), (4), and (5) and adding
1313 Subdivision (6) to read as follows:
1414 (1) within [five] fifteen miles of the boundary of a
1515 military base, as defined by Section 43.0117, at which an active
1616 training program is conducted;
1717 (4) in an area designated as an industrial district
1818 under Subsection 42.044; [or]
1919 (5) in an area subject to a strategic partnership
2020 agreement entered into under Section 43.0751, or any other
2121 agreement, including a development agreement entered into under
2222 Section 212.172; or [.]
2323 (6) in an area within a municipality’s certificate of
2424 convenience and necessity issued in accordance with Chapter 13,
2525 Subchapter G, Water Code.
2626 SECTION 2. Section 42.151, Local Government Code, is
2727 amended by amending Subdivisions (1), (4), and (5) and adding
2828 Subdivision (6) to read as follows:
2929 (1) within [five] fifteen miles of the boundary of a
3030 military base, as defined by Section 43.0117, at which an active
3131 training program is conducted;
3232 (4) in an area designated as an industrial district
3333 under Section 42.044; [or]
3434 (5) in an area subject to a strategic partnership
3535 agreement entered into under Section 43.0751, or any other
3636 agreement, including a development agreement entered into under
3737 Section 212.172; or [.]
3838 (6) in an area within a municipality’s certificate of
3939 convenience and necessity issued in accordance with Chapter 13,
4040 Subchapter G, Water Code.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2025.
