88 AN ACT
99 relating to the reimbursement rate for meals provided under the
1010 home-delivered meals program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 526, Government Code, as
1313 effective April 1, 2025, is amended by adding Section 526.0060 to
1414 read as follows:
1515 Sec. 526.0060. HOME-DELIVERED MEALS PROGRAM REIMBURSEMENT
1616 RATE; ANNUAL ADJUSTMENT. (a) In this section, "home-delivered
1717 meals program" means the program administered by the commission
1818 under which a contracted provider agency delivers meals to certain
1919 eligible individuals, including:
2020 (1) recipients receiving services under the STAR+PLUS
2121 home and community-based services (HCBS) waiver program;
2222 (2) individuals receiving community services and
2323 supports under Title XX of the Social Security Act (42 U.S.C.
2424 Section 1397 et seq.); and
2525 (3) individuals receiving services from area agencies
2626 on aging under the Older Americans Act of 1965 (42 U.S.C. Section
2727 3001 et seq.).
2828 (b) Subject to Subsection (c), the executive commissioner
2929 by rule shall increase the reimbursement rate ceiling prescribed
3030 for a meal provided under the home-delivered meals program to $10
3131 per meal.
3232 (c) Not later than October 1 of each year, the reimbursement
3333 rate ceiling for a meal provided under the home-delivered meals
3434 program must be adjusted to reflect the change in the Consumer Price
3535 Index for All Urban Consumers (CPI-U) published by the Bureau of
3636 Labor Statistics or its successor index during the preceding fiscal
3737 year.
3838 SECTION 2. If before implementing any provision of this Act
3939 a state agency determines that a waiver or authorization from a
4040 federal agency is necessary for implementation of that provision,
4141 the agency affected by the provision shall request the waiver or
4242 authorization and may delay implementing that provision until the
4343 waiver or authorization is granted.
4444 SECTION 3. This Act takes effect September 1, 2025.
