77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the Department of Public Safety performing rapid DNA
1010 testing of certain individuals crossing the Texas-Mexico border.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 421, Government Code, is amended by
1313 adding Subchapter G to read as follows:
1414 SUBCHAPTER G. RAPID DNA TESTING OF CERTAIN INDIVIDUALS CROSSING
1515 TEXAS-MEXICO BORDER
1616 Sec. 421.121. DEFINITIONS. In this subchapter:
1717 (1) "DNA" means deoxyribonucleic acid.
1818 (2) "Rapid DNA test" means a process for developing a
1919 DNA profile of an individual:
2020 (A) based on a biological sample consisting of a
2121 buccal swab of the individual; and
2222 (B) without the need for human intervention in
2323 the process or the use of facilities dedicated to performing DNA
2424 analyses and testing.
2525 Sec. 421.122. RAPID DNA TESTING PROGRAM; AGREEMENT. The
2626 Department of Public Safety shall enter into an agreement with the
2727 United States Department of Homeland Security on request to
2828 establish a program for:
2929 (1) performing rapid DNA tests of individuals who:
3030 (A) enter into this state by crossing the
3131 Texas-Mexico border;
3232 (B) are detained or arrested by the Department of
3333 Homeland Security; and
3434 (C) the Department of Homeland Security has
3535 reason to believe are misrepresenting the existence of a family
3636 relationship between the individual and another individual
3737 detained or arrested by the Department of Homeland Security; and
3838 (2) promptly providing the results of the rapid DNA
3939 tests to the Department of Homeland Security for use in the
4040 enforcement of federal immigration laws.
4141 Sec. 421.123. BIOLOGICAL SAMPLES TO BE DESTROYED. The
4242 Department of Public Safety shall destroy the biological sample
4343 used to perform a rapid DNA test under the agreement described by
4444 Section 421.122 after performing the test and providing the
4545 results.
4646 Sec. 421.124. DATABASE OF PROFILES PROHIBITED. The
4747 Department of Public Safety may not maintain a database of DNA
4848 profiles developed through rapid DNA tests performed under an
4949 agreement described by Section 421.122.
5050 Sec. 421.125. REQUIRED PROVISIONS. The agreement described
5151 by Section 421.122 must contain provisions that are substantially
5252 similar to the duty under Section 421.123 and the prohibition under
5353 Section 421.124.
5454 SECTION 2. This Act takes effect September 1, 2025.
