| 9 | 9 | | relating to prohibiting certain additives from being included in |

| 10 | 10 | | food and drinks provided by school districts. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter Z, Chapter 33, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 33.9011 to read as follows: |
|---|
| 14 | 14 | | Sec. 33.9011. PROHIBITION ON CERTAIN ADDITIVES IN FOOD AND |
|---|
| 15 | 15 | | DRINKS PROVIDED BY SCHOOLS. A school district or open-enrollment |
|---|
| 16 | 16 | | charter school that provides meals to students may not provide any |
|---|
| 17 | 17 | | food or drink that contains the following substances: |
|---|
| 18 | 18 | | (1) blue 1 (CAS 3844-45-9); |
|---|
| 19 | 19 | | (2) blue 2 (CAS 860-22-0); |
|---|
| 20 | 20 | | (3) green 3 (CAS 2353-45-9); |
|---|
| 21 | 21 | | (4) red 40 (CAS 25956-17-6); |
|---|
| 22 | 22 | | (5) yellow 5 (CAS 1934-21-0); |
|---|
| 23 | 23 | | (6) yellow 6 (CAS 2783-94-0); or |
|---|
| 24 | 24 | | (7) any additive that is substantially similar to an |
|---|
| 25 | 25 | | additive specified in Subdivisions (1) through (6). |
|---|
| 26 | 26 | | SECTION 2. This Act applies beginning with the 2025-2026 |
|---|
| 27 | 27 | | school year. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2025. |
|---|
