| 9 | 9 | | relating to a compliance agreement for the suspension of an |

| 10 | 10 | | enforcement action against a regional water supply, sewer, |
|---|
| 11 | 11 | | wastewater treatment, or solid waste disposal service for certain |
|---|
| 12 | 12 | | violations. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Sections 7.0026(b) and (c), Water Code, are |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (b) If a water supply, sewer, wastewater treatment, or solid |
|---|
| 17 | 17 | | waste disposal service operated by or for a municipality, [or] |
|---|
| 18 | 18 | | county, regional service area, or unincorporated service area is |
|---|
| 19 | 19 | | being integrated into a regional water supply, sewer, wastewater |
|---|
| 20 | 20 | | treatment, or solid waste disposal service administered by another |
|---|
| 21 | 21 | | entity, including a retail public utility, the commission may enter |
|---|
| 22 | 22 | | into a compliance agreement with the regional service under which |
|---|
| 23 | 23 | | the commission will not initiate an enforcement action against the |
|---|
| 24 | 24 | | regional service for existing or anticipated violations resulting |
|---|
| 25 | 25 | | from the operation by the regional service of the service being |
|---|
| 26 | 26 | | integrated. A compliance agreement under this section must |
|---|
| 27 | 27 | | include provisions necessary to bring the service being integrated |
|---|
| 28 | 28 | | into compliance. |
|---|
| 29 | 29 | | (c) If a water supply, sewer, or wastewater treatment |
|---|
| 30 | 30 | | service operated by a retail public utility, other than a |
|---|
| 31 | 31 | | municipality or county, is being integrated into a regional water |
|---|
| 32 | 32 | | supply, sewer, or wastewater treatment service administered by |
|---|
| 33 | 33 | | another entity, including a separate retail public utility, the |
|---|
| 34 | 34 | | commission may enter into a compliance agreement with the regional |
|---|
| 35 | 35 | | service under which the commission will not initiate an enforcement |
|---|
| 36 | 36 | | action against the regional service for existing or anticipated |
|---|
| 37 | 37 | | violations resulting from the operation by the regional service of |
|---|
| 38 | 38 | | the service being integrated. A compliance agreement under this |
|---|
| 39 | 39 | | section must include provisions necessary to bring the service |
|---|
| 40 | 40 | | being integrated into compliance. |

| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2025. |
