77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a compliance agreement for the suspension of an
1010 enforcement action against a regional water supply, sewer,
1111 wastewater treatment, or solid waste disposal service for certain
1212 violations.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 7.0026(b) and (c), Water Code, are
1515 amended to read as follows:
1616 (b) If a water supply, sewer, wastewater treatment, or solid
1717 waste disposal service operated by or for a municipality, [or]
1818 county, regional service area, or unincorporated service area is
1919 being integrated into a regional water supply, sewer, wastewater
2020 treatment, or solid waste disposal service administered by another
2121 entity, including a retail public utility, the commission may enter
2222 into a compliance agreement with the regional service under which
2323 the commission will not initiate an enforcement action against the
2424 regional service for existing or anticipated violations resulting
2525 from the operation by the regional service of the service being
2626 integrated. A compliance agreement under this section must
2727 include provisions necessary to bring the service being integrated
2828 into compliance.
2929 (c) If a water supply, sewer, or wastewater treatment
3030 service operated by a retail public utility, other than a
3131 municipality or county, is being integrated into a regional water
3232 supply, sewer, or wastewater treatment service administered by
3333 another entity, including a separate retail public utility, the
3434 commission may enter into a compliance agreement with the regional
3535 service under which the commission will not initiate an enforcement
3636 action against the regional service for existing or anticipated
3737 violations resulting from the operation by the regional service of
3838 the service being integrated. A compliance agreement under this
3939 section must include provisions necessary to bring the service
4040 being integrated into compliance.
4141 SECTION 2. This Act takes effect September 1, 2025.
