77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the applicability of certain parental notification
1010 requirements to school districts of innovation.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 12A.004(a), Education Code, is amended
1313 to read as follows:
1414 (a) A local innovation plan may not provide for the
1515 exemption of a district designated as a district of innovation from
1616 the following provisions of this title:
1717 (1) a state or federal requirement applicable to an
1818 open-enrollment charter school operating under Subchapter D,
1919 Chapter 12;
2020 (2) Subchapters A, C, D, and E, Chapter 11, except that
2121 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2222 Section 11.162;
2323 (3) parental notification requirements under Section
2424 21.057;
2525 (4) state curriculum and graduation requirements
2626 adopted under Chapter 28; and
2727 (5) [(4)] academic and financial accountability and
2828 sanctions under Chapters 39 and 39A.
2929 SECTION 2. Section 12A.004(a), Education Code, as amended
3030 by this Act, applies to each local innovation plan adopted under
3131 Chapter 12A, Education Code, regardless of whether the plan was
3232 adopted before, on, or after the effective date of this Act. A local
3333 innovation plan adopted or renewed before the effective date of
3434 this Act must comply with Section 12A.004(a), Education Code, as
3535 amended by this Act, not later than September 1, 2025.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2025.
