77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study on health benefit plan coverage for certain
1010 treatments of traumatic brain injuries.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this Act:
1313 (1) "Department" means the Texas Department of
1414 Insurance.
1515 (2) "Traumatic brain injury" means an acquired injury
1616 to the brain, including brain injuries caused by anoxia due to near
1717 drowning. The term does not include brain dysfunction caused by
1818 congenital or degenerative disorders or birth trauma.
1919 (3) "Traumatic brain injury treatment" means
2020 cognitive rehabilitation therapy, cognitive communication therapy,
2121 neurocognitive therapy and rehabilitation, neurobehavioral,
2222 neurophysiological, neuropsychological, and psychophysiological
2323 testing and treatment, neurofeedback therapy, and remediation
2424 required for and related to treatment of a traumatic brain injury.
2525 (b) The department, in consultation with the Texas
2626 Traumatic Brain Injury Advisory Council, shall conduct a study on
2727 the effect of Chapter 1352, Insurance Code, on the coverage of
2828 traumatic brain injury treatment by health benefit plans offered in
2929 this state.
3030 (c) In conducting the study, the department shall:
3131 (1) review the number, types, and outcome of claims
3232 made in this state for treatment of traumatic brain injuries;
3333 (2) review the coverage offered for traumatic brain
3434 injury treatment by health benefit plans in this state;
3535 (3) determine the effect, if any, of substance abuse,
3636 including opioid abuse and addiction, on traumatic brain injury
3737 coverage and treatment in this state; and
3838 (4) analyze the effect of any exclusions or exceptions
3939 in health benefit plan coverage of traumatic brain injury
4040 treatment, including exclusions for injuries caused by self-harm or
4141 substance abuse.
4242 (d) In conducting the study, the department may request from
4343 a health benefit plan issuer and a health benefit plan issuer shall
4444 provide deidentified and aggregated information on claims for
4545 traumatic brain injuries.
4646 (e) Not later than December 1, 2026, the department shall
4747 submit to the governor, the lieutenant governor, the speaker of the
4848 house of representatives, and the chair of the standing committee
4949 of each house of the legislature with primary jurisdiction over the
5050 department a written report that includes:
5151 (1) the findings of the study conducted under this
5252 section; and
5353 (2) any recommendations for legislative or other
5454 action related to coverage and treatment of traumatic brain
5555 injuries.
5656 (f) This Act expires September 1, 2027.
5757 SECTION 2. This Act takes effect September 1, 2025.
