88 AN ACT
99 relating to minimum standards for pregnancy resource centers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1212 amended by adding Chapter 174 to read as follows:
1313 CHAPTER 174. PREGNANCY RESOURCE CENTERS
1414 Sec. 174.001. DEFINITION. In this chapter, "pregnancy
1515 resource center" means an organization, including a pregnancy
1616 counseling organization, crisis pregnancy center, pregnancy care
1717 center, and pregnancy support center, that for a fee or free of
1818 charge provides pregnancy counseling or information but:
1919 (1) does not perform abortions or make referrals to an
2020 abortion provider;
2121 (2) does not provide or make referrals for
2222 comprehensive birth control services;
2323 (3) is not licensed or certified by this state or the
2424 federal government to provide medical or health care services; and
2525 (4) is not required to contract with a physician to
2626 provide or directly supervise all health care services provided by
2727 the organization.
2828 Sec. 174.002. MINIMUM STANDARDS. (a) The executive
2929 commissioner by rule shall prescribe minimum standards for
3030 pregnancy resource centers.
3131 (b) The minimum standards must:
3232 (1) protect the health and safety of a patient of a
3333 pregnancy resource center;
3434 (2) contain provisions equivalent to the requirements
3535 of Subchapter B, Chapter 171, but applicable to the provision of
3636 pregnancy services; and
3737 (3) contain provisions equivalent to the minimum
3838 standards for ambulatory surgical centers adopted under Section
3939 243.010.
4040 (c) Pregnancy resource centers must have present when
4141 providing services to a patient at least one licensed obstetrician
4242 or gynecologist.
4343 (d) This section does not authorize the executive
4444 commissioner to:
4545 (1) establish the qualifications of a licensed health
4646 care practitioner; or
4747 (2) allow a person to provide medical or health care
4848 services who is not authorized to provide those services under
4949 other laws of this state.
5050 (e) A pregnancy resource center or health care practitioner
5151 that violates this section is subject to disciplinary action by the
5252 state agency that regulates the center or practitioner as if the
5353 center or practitioner had violated the applicable licensing law.
5454 SECTION 2. Not later than January 1, 2026, the executive
5555 commissioner of the Health and Human Services Commission shall
5656 adopt rules necessary to implement Chapter 174, Health and Safety
5757 Code, as added by this Act.
5858 SECTION 3. This Act takes effect September 1, 2025.
