| 9 | 9 | | relating to the permitting and inspection of mobile food units. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 437, Health and Safety Code, is amended |
|---|
| 12 | 12 | | by adding Section 437.0101 to read as follows: |
|---|
| 13 | 13 | | Sec. 437.0101. PLAN SUBMISSION AND SUBSEQUENT INSPECTION OF |
|---|
| 14 | 14 | | MOBILE FOOD UNITS. (a) Before issuing a permit, a county or public |
|---|
| 15 | 15 | | health district shall require a mobile food unit applicant to |
|---|
| 16 | 16 | | provide plans of the unit's food preparation, storage, and sales |
|---|
| 17 | 17 | | areas to determine whether the applicant is in compliance with |
|---|
| 18 | 18 | | state law, applicable local law, and rules adopted under state law |
|---|
| 19 | 19 | | governing the applicant. |
|---|
| 20 | 20 | | (b) In addition to the initial permitting inspection, a |
|---|
| 21 | 21 | | county or public health district shall conduct a preoperational |
|---|
| 22 | 22 | | inspection to verify the mobile food unit: |
|---|
| 23 | 23 | | (1) is constructed and equipped in accordance with the |
|---|
| 24 | 24 | | approved plans and approved modification of those plans; |
|---|
| 25 | 25 | | (2) established standard operating procedures in |
|---|
| 26 | 26 | | accordance with state law; and |
|---|
| 27 | 27 | | (3) otherwise is in compliance with state law. |
|---|
| 28 | 28 | | (c) If a county or public health district determines on a |
|---|
| 29 | 29 | | permitting or preoperational inspection that a mobile food unit |
|---|
| 30 | 30 | | applicant is not in compliance with state law, applicable local |
|---|
| 31 | 31 | | law, or rules adopted under state law, the county or public health |
|---|
| 32 | 32 | | district may reinspect the applicant on a later date to determine |
|---|
| 33 | 33 | | whether the applicant is in compliance. |
|---|
| 34 | 34 | | SECTION 2. (a) As soon as practicable after the effective |
|---|
| 35 | 35 | | date of this Act, the executive commissioner of the Health and Human |
|---|
| 36 | 36 | | Services Commission shall adopt the rules necessary to implement |
|---|
| 37 | 37 | | the changes in law made by this Act. |
|---|
| 38 | 38 | | (b) The changes in law made by this Act apply only to an |
|---|
| 39 | 39 | | application filed or inspection conducted on or after the effective |
|---|
| 40 | 40 | | date of this Act. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
