77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the permitting and inspection of mobile food units.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 437, Health and Safety Code, is amended
1212 by adding Section 437.0101 to read as follows:
1313 Sec. 437.0101. PLAN SUBMISSION AND SUBSEQUENT INSPECTION OF
1414 MOBILE FOOD UNITS. (a) Before issuing a permit, a county or public
1515 health district shall require a mobile food unit applicant to
1616 provide plans of the unit's food preparation, storage, and sales
1717 areas to determine whether the applicant is in compliance with
1818 state law, applicable local law, and rules adopted under state law
1919 governing the applicant.
2020 (b) In addition to the initial permitting inspection, a
2121 county or public health district shall conduct a preoperational
2222 inspection to verify the mobile food unit:
2323 (1) is constructed and equipped in accordance with the
2424 approved plans and approved modification of those plans;
2525 (2) established standard operating procedures in
2626 accordance with state law; and
2727 (3) otherwise is in compliance with state law.
2828 (c) If a county or public health district determines on a
2929 permitting or preoperational inspection that a mobile food unit
3030 applicant is not in compliance with state law, applicable local
3131 law, or rules adopted under state law, the county or public health
3232 district may reinspect the applicant on a later date to determine
3333 whether the applicant is in compliance.
3434 SECTION 2. (a) As soon as practicable after the effective
3535 date of this Act, the executive commissioner of the Health and Human
3636 Services Commission shall adopt the rules necessary to implement
3737 the changes in law made by this Act.
3838 (b) The changes in law made by this Act apply only to an
3939 application filed or inspection conducted on or after the effective
4040 date of this Act.
4141 SECTION 3. This Act takes effect September 1, 2025.
