77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to students enrolled in public schools subject to
1010 in-school or out-of-school suspension.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 37.005(a) and (b), Education Code, are
1313 amended to read as follows:
1414 (a) The principal or other appropriate administrator may
1515 suspend a student who engages in conduct identified in the student
1616 code of conduct adopted under Section 37.001 as conduct for which a
1717 student may be subject to an in-school or out-of-school suspension
1818 [suspended].
1919 (b) An out-of-school [A] suspension under this section may
2020 not exceed three school days.
2121 SECTION 2. This Act applies beginning with the 2025-2026
2222 school year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2025.
