| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Sections 37.005(a) and (b), Education Code, are | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | (a) The principal or other appropriate administrator may | |
| 15 | 15 | suspend a student who engages in conduct identified in the student | |
| 16 | 16 | code of conduct adopted under Section 37.001 as conduct for which a | |
| 17 | 17 | student may be subject to an in-school or out-of-school suspension | |
| 18 | 18 | [suspended]. | |
| 19 | 19 | (b) An out-of-school [A] suspension under this section may | |
| 20 | 20 | not exceed three school days. | |
| 21 | 21 | SECTION 2. This Act applies beginning with the 2025-2026 | |
| 22 | 22 | school year. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2025. |
