77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the grant program distributing money from the
1010 transportation infrastructure fund.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 256.103(b), Transportation Code, is
1313 amended to read as follows:
1414 (b) Grants distributed during a fiscal year must be
1515 allocated among counties as follows:
1616 (1) 10 percent according to weight tolerance permits,
1717 determined by the ratio of weight tolerance permits issued in the
1818 preceding fiscal year for the county to the total number of weight
1919 tolerance permits issued in the state in that fiscal year, as
2020 determined by the Texas Department of Motor Vehicles;
2121 (2) 15 [20] percent according to oil and gas
2222 production taxes, determined by the ratio of oil and gas production
2323 taxes collected by the comptroller in the preceding fiscal year in
2424 the county to the total amount of oil and gas production taxes
2525 collected in the state in that fiscal year, as determined by the
2626 comptroller;
2727 (3) 40 [45] percent according to horizontal well
2828 completions, determined by the ratio of horizontal well completions
2929 in the preceding fiscal year in the county to the total number of
3030 horizontal well completions in the state in that fiscal year, as
3131 determined by the Railroad Commission of Texas;
3232 (4) 10 percent according to the volume of oil and gas
3333 waste injected, determined by the ratio of the volume of oil and gas
3434 waste injected in the preceding fiscal year in the county to the
3535 total volume of oil and gas waste injected in the state in that
3636 fiscal year, as determined by the Railroad Commission of Texas;
3737 [and]
3838 (5) 10 [15] percent according to vertical well
3939 completions, determined by the ratio of vertical well completions
4040 in the preceding fiscal year in the county to the total number of
4141 vertical well completions in the state in that fiscal year, as
4242 determined by the Railroad Commission of Texas;
4343 (6) 10 percent according to regularly producing
4444 horizontal wells, determined by the ratio of regularly producing
4545 horizontal wells in the preceding fiscal year in a county adjacent
4646 to the county that applies for a grant under this subchapter to the
4747 total number of regularly producing horizontal wells in the state
4848 in that fiscal year, as determined by the Railroad Commission of
4949 Texas, to be distributed equally among counties that are adjacent
5050 to the county where the production occurred and that have applied
5151 for a grant under this subchapter; and
5252 (7) five percent according to regularly producing
5353 vertical wells, determined by the ratio of regularly producing
5454 vertical wells in the preceding fiscal year in a county adjacent to
5555 the county that applies for a grant under this subchapter to the
5656 total number of regularly producing vertical wells in the state in
5757 that fiscal year, as determined by the Railroad Commission of
5858 Texas, to be distributed equally among counties that are adjacent
5959 to the county where the production occurred and that have applied
6060 for a grant under this subchapter.
6161 SECTION 2. This Act takes effect September 1, 2025.
