7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the grant program distributing money from the
10	10	transportation infrastructure fund.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 256.103(b), Transportation Code, is
13	13	amended to read as follows:
14	14	(b) Grants distributed during a fiscal year must be
15	15	allocated among counties as follows:
16	16	(1) 10 percent according to weight tolerance permits,
17	17	determined by the ratio of weight tolerance permits issued in the
18	18	preceding fiscal year for the county to the total number of weight
19	19	tolerance permits issued in the state in that fiscal year, as
20	20	determined by the Texas Department of Motor Vehicles;
21	21	(2) 15 [20] percent according to oil and gas
22	22	production taxes, determined by the ratio of oil and gas production
23	23	taxes collected by the comptroller in the preceding fiscal year in
24	24	the county to the total amount of oil and gas production taxes
25	25	collected in the state in that fiscal year, as determined by the
26	26	comptroller;
27	27	(3) 40 [45] percent according to horizontal well
28	28	completions, determined by the ratio of horizontal well completions
29	29	in the preceding fiscal year in the county to the total number of
30	30	horizontal well completions in the state in that fiscal year, as
31	31	determined by the Railroad Commission of Texas;
32	32	(4) 10 percent according to the volume of oil and gas
33	33	waste injected, determined by the ratio of the volume of oil and gas
34	34	waste injected in the preceding fiscal year in the county to the
35	35	total volume of oil and gas waste injected in the state in that
36	36	fiscal year, as determined by the Railroad Commission of Texas;
37	37	[and]
38	38	(5) 10 [15] percent according to vertical well
39	39	completions, determined by the ratio of vertical well completions
40	40	in the preceding fiscal year in the county to the total number of
41	41	vertical well completions in the state in that fiscal year, as
42	42	determined by the Railroad Commission of Texas;
43	43	(6) 10 percent according to regularly producing
44	44	horizontal wells, determined by the ratio of regularly producing
45	45	horizontal wells in the preceding fiscal year in a county adjacent
46	46	to the county that applies for a grant under this subchapter to the
47	47	total number of regularly producing horizontal wells in the state
48	48	in that fiscal year, as determined by the Railroad Commission of
49	49	Texas, to be distributed equally among counties that are adjacent
50	50	to the county where the production occurred and that have applied
51	51	for a grant under this subchapter; and
52	52	(7) five percent according to regularly producing
53	53	vertical wells, determined by the ratio of regularly producing
54	54	vertical wells in the preceding fiscal year in a county adjacent to
55	55	the county that applies for a grant under this subchapter to the
56	56	total number of regularly producing vertical wells in the state in
57	57	that fiscal year, as determined by the Railroad Commission of
58	58	Texas, to be distributed equally among counties that are adjacent
59	59	to the county where the production occurred and that have applied
60	60	for a grant under this subchapter.
61	61	SECTION 2. This Act takes effect September 1, 2025.
