77 AN ACT
88 relating to the provision of services by nonphysician mental health
99 professionals at school districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 38.0101, Education Code, is amended to
1212 read as follows:
1313 Sec. 38.0101. [AUTHORITY TO EMPLOY OR CONTRACT WITH]
1414 NONPHYSICIAN MENTAL HEALTH PROFESSIONALS [PROFESSIONAL]. (a) A
1515 school district shall [may] employ or contract with one or more
1616 nonphysician mental health professionals to provide services at
1717 each district campus. A school district must provide at least one
1818 nonphysician mental health professional for every 600 students at
1919 each campus.
2020 (b) A nonphysician mental health professional providing
2121 services under this section shall implement a comprehensive mental
2222 health program for the campus the professional serves and spend at
2323 least 80 percent of the professional's total work time providing
2424 direct or indirect mental health services to students. The
2525 commissioner shall adopt rules as necessary to administer this
2626 subsection.
2727 (c) In this section, "nonphysician mental health
2828 professional" means:
2929 (1) a psychologist licensed to practice in this state
3030 and designated as a health-service provider;
3131 (2) a registered nurse with a master's or doctoral
3232 degree in psychiatric nursing;
3333 (3) a licensed clinical social worker;
3434 (4) a professional counselor licensed to practice in
3535 this state; or
3636 (5) a marriage and family therapist licensed to
3737 practice in this state.
3838 (d) Each school district must demonstrate to the agency
3939 compliance with this section not later than August 1, 2027. This
4040 subsection expires August 1, 2028.
4141 SECTION 2. This Act takes effect September 1, 2025.
