88 AN ACT
99 relating to county and municipal regulation of automated external
1010 defibrillators.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 122, Health and Safety Code, is amended
1313 by adding Section 122.009 to read as follows:
1414 Sec. 122.009. COUNTY AND MUNICIPAL REGULATION OF AUTOMATED
1515 EXTERNAL DEFIBRILLATORS. (a) In this section, "automated external
1616 defibrillator" has the meaning assigned by Section 779.001.
1717 (b) After public notice and hearing, a county or
1818 municipality by order or ordinance may require automated external
1919 defibrillators to be installed and maintained in structures subject
2020 to county or municipal licensure or other regulation to provide
2121 adequate emergency preparedness. The order or ordinance:
2222 (1) may specify the structures subject to the
2323 requirement and the minimum number and position of required
2424 automated external defibrillators;
2525 (2) may not apply to a health facility licensed under
2626 Title 4 or a premises with an occupancy limit of 30 or fewer
2727 persons; and
2828 (3) may provide exceptions and a variance process to
2929 ensure small businesses are not adversely impacted.
3030 (c) The governing body of a municipality or the
3131 commissioners court of a county shall consult with the county or
3232 municipal fire marshal, the county or municipal fire chief, or
3333 other local official with authority over emergency matters to
3434 determine whether to require automated external defibrillators
3535 under Subsection (b) and the structures subject to the requirement.
3636 (d) A county order adopted under Subsection (b) does not
3737 apply to structures within a municipality and the municipality's
3838 extraterritorial jurisdiction if the municipality has adopted an
3939 ordinance under Subsection (b). A municipal ordinance may apply to
4040 structures within the municipality's extraterritorial
4141 jurisdiction.
4242 (e) A county or municipality:
4343 (1) may inspect a structure subject to an order or
4444 ordinance adopted under Subsection (b) to ensure compliance with
4545 the order or ordinance; and
4646 (2) may not impose application or inspection fees
4747 related to an order or ordinance adopted under Subsection (b).
4848 (f) Chapter 779 applies to automated external
4949 defibrillators required under an order or ordinance adopted under
5050 Subsection (b).
5151 (g) A county or municipality and county or municipal elected
5252 or appointed officials, employees, and agents are not liable for
5353 the regulation of or failure to regulate automated external
5454 defibrillators.
5555 SECTION 2. This Act takes effect September 1, 2025.
