1411 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15- SECTION 1. Article 19A.051(c), Code of Criminal Procedure,
12+ SECTION 1. Chapter 30, Civil Practice and Remedies Code, is
13+ amended by adding Section 30.0071 to read as follows:
14+ Sec. 30.0071. DEMAND FOR JURY; JURY FEE. (a) A court in
15+ this state may not summon a jury in a civil trial unless a party to
16+ the civil action, not less than the 30th day before the first
17+ scheduled trial date:
18+ (1) files a written demand for a jury trial with the
19+ clerk of the court; and
20+ (2) pays to the clerk of the court a jury fee of $50.
21+ (b) The clerk of the court shall deposit a jury fee paid to
22+ the clerk under this section to the county jury fund under Chapter
23+ 135, Local Government Code. The jury fee assessed under this
24+ section is in addition to the money allocated to the county jury
25+ fund.
26+ SECTION 2. Article 19A.051(c), Code of Criminal Procedure,
1627 is amended to read as follows:
1728 (c) The judge shall test the qualifications for and
1829 exemptions [excuses] from service as a grand juror and impanel the
1930 completed grand jury as provided by this chapter.

2738 DISQUALIFIED PERSONS. (a) A person may be selected or serve as a

2940 (1) is at least 18 years of age;
3041 (2) is a citizen of the United States;
3142 (3) is a resident of this state and of the county in
3243 which the person is to serve;
3344 (4) is qualified under the constitution and other laws
3445 to vote in the county in which the grand jury is sitting, regardless
3546 of whether the person is registered to vote;
3647 (5) is of sound mind and good moral character;
3748 (6) is able to read and write;
3849 (7) has never been convicted of misdemeanor theft [or
3950 a felony];
4051 (8) has never been convicted of a felony;
4152 (9) is not under indictment or other legal accusation
4253 for misdemeanor theft or a felony;
4354 (10) [(9)] is not related within the third degree by
4455 consanguinity or second degree by affinity, as determined under
4556 Chapter 573, Government Code, to any person selected to serve or
4657 serving on the same grand jury;
4758 (11) [(10)] has not served as a grand juror in the year
4859 before the date on which the term of court for which the person has
4960 been selected as a grand juror begins; and
5061 (12) [(11)] is not a complainant in any matter to be
5162 heard by the grand jury during the term of court for which the
5263 person has been selected as a grand juror.
5364 (b) On the third business day of each month, the clerk of the
5465 district court shall prepare:
5566 (1) a list of persons who in the preceding month were
5667 disqualified from serving as a grand juror based on the person's
5768 citizenship [or indictment or conviction for misdemeanor theft or a
5869 felony] and send a copy of the list to:
5970 (A) [(1)] the secretary of state;
6071 (B) the voter registrar for the county in which
6172 the grand jury is sitting; and
6273 (C) [(2)] the prosecuting attorney for the court
6374 to which the grand jurors were summoned for investigation into
6475 whether any person made a false claim concerning the person's
65- qualification under Subsection (a)(2);
76+ qualification under Subsection (a)(2)[, (7), or (8)];
6677 (2) a list of persons who in the preceding month were
6778 disqualified from serving as a grand juror based on the person's

94104 younger than 18 years of age and who will be without adequate
95105 supervision if the person serves on the grand jury;
96106 (3) a student of a public or private secondary school;
97107 (4) a person enrolled in and in actual attendance at an
98108 institution of higher education; and
99109 (5) any other person the court determines has a
100110 reasonable excuse from service.
101- SECTION 5. Subchapter C, Chapter 19A, Code of Criminal

104114 Art. 19A.106. PERMANENT EXEMPTION FOR ELDERLY. (a) A
105115 person who is entitled to exemption from grand jury service because
106116 the person is 75 years of age or older may establish a permanent
107117 exemption on that ground as provided by this article.
108118 (b) A person may claim a permanent exemption by filing with
109119 the district clerk or the clerk of a district court in the county,
110120 through an electronic transmission, mail, or personal delivery, a
111121 signed statement affirming the person is 75 years of age or older
112122 and desires a permanent exemption on that ground.
113123 (c) The district clerk shall maintain a current register of
114124 the name of each person who resides in the county and who has
115125 claimed and is entitled to a permanent exemption from grand jury
116126 service because the person is 75 years of age or older.
117127 (d) On the third business day of each month, the district
118128 clerk shall prepare a list of persons who in the preceding month
119129 were permanently exempted from serving as a grand juror under this
120- article or rescinded a permanent exemption under Subsection (f) and
121- send a copy of the list to the secretary of state and the voter
122- registrar of each county served by the clerk.

134143 Art. 19A.107. LIST OF DISQUALIFIED CONVICTED PERSONS. (a)
135144 The district clerk shall maintain a list of the name and address of
136145 each person who is disqualified under this subchapter from grand
137146 jury service because the person was convicted of misdemeanor theft
138147 or a felony.
139148 (b) A person who was convicted of misdemeanor theft or a
140149 felony is permanently disqualified from serving as a juror.
141150 (c) A person whose name appears on the list maintained under
142151 this article may not be selected or summoned for grand jury service
143152 by any judge of a district court served by the clerk.
144153 (d) On the third business day of each month, the district
145154 clerk shall send a copy of the list maintained under this article
146- to:

147156 (1) the secretary of state;
148157 (2) the voter registrar for the county in which the
149158 grand jury is sitting; and
150159 (3) the prosecuting attorney for the court to which
151160 the grand jurors were summoned for investigation into whether any

156165 (a) The jury wheel must be reconstituted by using, as the

158167 (1) the names of all persons on the current voter
159168 registration lists from all the precincts in the county; and
160169 (2) all names on a current list to be furnished by the
161170 Department of Public Safety, showing the citizens of the county
162171 who:
163172 (A) hold a valid Texas driver's license or a
164173 valid personal identification card or certificate issued by the
165174 department; and
166175 (B) are not disqualified from jury service under
167176 Section 62.102(1), (2), (3), (7), or (8).
168177 (b) Notwithstanding Subsection (a), the names of persons
169178 listed on a register of persons exempt from jury service may not be
170- placed in the jury wheel, as provided by Sections 62.108 and[,]
171- 62.109 [, 62.113, 62.114, and 62.115].
172- SECTION 7. Section 62.0132(g), Government Code, is amended

180189 action in which the respondent to the questionnaire is a potential

182191 (4) other than information provided that is related to
183192 Section 62.102(2), (3), (7), (8), or (9) [62.102(8) or (9)], the
184193 voter registrar of a county in connection with any matter of voter
185194 registration or the administration of elections.
186- SECTION 8. Section 62.102, Government Code, is amended to

209- SECTION 9. Section 62.106(a), Government Code, is amended

211220 (a) A person qualified to serve as a petit juror may
212221 establish an exemption from jury service if the person:
213222 (1) is [over] 75 years of age or older;
214223 (2) has legal custody of a child younger than 12 years
215224 of age and the person's service on the jury requires leaving the
216225 child without adequate supervision;
217226 (3) is a student of a public or private secondary
218227 school;
219228 (4) is a person enrolled and in actual attendance at an
220229 institution of higher education;
221230 (5) is an officer or an employee of the senate, the
222231 house of representatives, or any department, commission, board,
223232 office, or other agency in the legislative branch of state
224233 government;
225234 (6) is summoned for service in a county with a
226235 population of at least 200,000, unless that county uses a jury plan
227236 under Section 62.011 and the period authorized under Section
228237 62.011(b)(5) exceeds two years, and the person has served as a petit
229238 juror in the county during the 24-month period preceding the date
230239 the person is to appear for jury service;
231240 (7) is the primary caretaker of a person who is unable
232241 to care for himself or herself;
233242 (8) except as provided by Subsection (b), is summoned
234243 for service in a county with a population of at least 250,000 and
235244 the person has served as a petit juror in the county during the
236245 three-year period preceding the date the person is to appear for
237246 jury service; or
238247 (9) is a member of the United States military forces
239248 serving on active duty and deployed to a location away from the
240249 person's home station and out of the person's county of residence.
241- SECTION 10. Section 62.107(c), Government Code, is amended

253- SECTION 11. Section 62.108, Government Code, is amended by

264273 older and desires a permanent exemption on that ground; or
265274 (2) in the manner provided by Section 62.107(c).
266275 (c) The district clerk [voter registrar] of the county shall
267276 maintain a current register indicating the name of each person who
268277 has claimed and is entitled to a permanent exemption from jury
269278 service because the person is [over] 75 years of age or older.
270279 (c-1) On the third business day of each month, the district
271280 clerk shall prepare a list of persons who in the preceding month
272281 claimed and were entitled to a permanent exemption under this
273- section or a rescission of a permanent exemption under Subsection
274- (e) and send a copy of the list to the secretary of state and the
282+ section and send a copy of the list to the secretary of state and the
275283 voter registrar of each county served by the clerk.
276284 (e) A person who has claimed a permanent exemption from jury
277285 service because the person is [over] 75 years of age or older may
278286 rescind the exemption at any time by filing a signed request for the
279287 rescission with the voter registrar of the county. Rescission of a
280288 permanent exemption does not affect the right of a person who is
281289 [over] 75 years of age or older to claim permanent exemption at a
282290 later time.
283- SECTION 12. Section 62.109, Government Code, is amended by

290298 inability to comprehend or communicate in the English language that
291299 makes it impossible or very difficult for the person to serve on a
292300 jury.
293301 (b) A person requesting an exemption under this section must
294302 submit to the court or the district clerk an affidavit stating the
295303 person's name and address and the reason for and the duration of the
296304 requested exemption. A person requesting an exemption due to a
297305 physical or mental impairment must attach to the affidavit a
298306 statement from a physician. The affidavit and physician's
299307 statement may be submitted to the court at the time the person is
300308 summoned for jury service or at any other time.
301309 (b-1) The district clerk shall maintain a current list
302310 indicating the name of each person permanently or temporarily
303311 exempt under this section and the period of the exemption.
304312 (d) A person included on the list maintained under
305313 Subsection (b-1) [listed on the register] may not be summoned for
306314 jury service during the period for which the person is exempt. The
307315 name of a person included on the list maintained under Subsection
308316 (b-1) [listed on the register] may not be placed in the jury wheel
309317 or otherwise used in preparing the record of names from which a jury
310318 list is selected during the period for which the person is exempt.
311319 (e) A person exempt from jury service under this section may
312320 rescind the exemption at any time by filing a signed request for the
313321 rescission with the district clerk [voter registrar] of the county.
314- SECTION 13. Sections 62.113(a) and (b), Government Code,

326334 investigation of whether the person committed an offense under
327335 Section 13.007, Election Code, or other law.
328- SECTION 14. Sections 62.114(a) and (b), Government Code,

330338 (a) The clerk of the court shall maintain a list containing
331339 the name and address of each person who is [excused or] disqualified
332340 under this subchapter from jury service because the person is not a
333341 resident of the county.
334342 (b) On the third business day of each month, the clerk shall
335343 send a copy of the list of persons [excused or] disqualified in the
336344 previous month because the persons do not reside in the county to:
337345 (1) the voter registrar of the county; and
338346 (2) the secretary of state.
339- SECTION 15. Sections 62.115(c) and (d), Government Code,

341349 (c) The district clerk shall [may] remove from the jury
342350 wheel the jury wheel card for the person whose name appears on the
343351 list.
344352 (d) On the third business day of each month, the clerk shall

346- disqualified because of a conviction of misdemeanor theft or a
347- felony to:
353+ send a list of the persons disqualified based on the person's
354+ conviction for misdemeanor theft or a felony to:
348355 (1) the secretary of state;
349356 (2) the voter registrar of the county; and
350357 (3) the prosecuting attorney for a court to which a
351358 person was summoned for investigation into whether the person
352- falsely made a claim related to a disqualification under Section
353- 62.102(7) or (8) [in the preceding month].
354- SECTION 16. The changes in law made by this Act apply only
359+ falsely claimed a disqualification under Section 62.102(a)(7) or
360+ (8) [to the secretary of state a copy of the list of persons
361+ disqualified because of a conviction of misdemeanor theft or a
362+ felony in the preceding month].
363+ SECTION 17. Section 30.0071, Civil Practice and Remedies
364+ Code, as added by this Act, applies only to a jury demand filed on or
365+ after the effective date of this Act. A jury demand filed before
366+ the effective date of this Act is governed by the law in effect when
367+ the demand was filed, and the former law is continued in effect for
368+ that purpose.
369+ SECTION 18. The changes in law made by this Act apply only
355370 to a person who is summoned to appear for service on a grand jury or
356371 petit jury on or after the effective date of this Act. A person who
357372 is summoned to appear for service on a grand jury or petit jury
358373 before the effective date of this Act is governed by the law in
359374 effect on the date the person was summoned, and the former law is
360375 continued in effect for that purpose.
361- SECTION 17. This Act takes effect September 1, 2025.
