| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Subchapter F, Chapter 4201, Insurance Code, is | |
| 14 | 14 | amended by adding Section 4201.254 to read as follows: | |
| 15 | 15 | Sec. 4201.254. PREAUTHORIZATION DETERMINATION BY PHYSICIAN | |
| 16 | 16 | OF RELEVANT SPECIALTY REQUIRED. (a) In this section, | |
| 17 | 17 | "preauthorization" has the meaning assigned by Section 4201.651. | |
| 18 | 18 | (b) A preauthorization determination must be made by a | |
| 19 | 19 | physician who is of the same specialty as the physician or health | |
| 20 | 20 | care provider proposing to provide the service or recommending the | |
| 21 | 21 | provision of the service. | |
| 22 | 22 | SECTION 2. Section 4201.254, Insurance Code, as added by | |
| 23 | 23 | this Act, applies only to a request for preauthorization of health | |
| 24 | 24 | care services made on or after January 1, 2026. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2025. |
