77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the use of deadly force to make an arrest.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 9.51(c) and (d), Penal Code, are
1212 amended to read as follows:
1313 (c) A peace officer is justified in using deadly force
1414 against another when and to the degree the peace officer reasonably
1515 believes the deadly force is immediately necessary to make an
1616 arrest, or to prevent escape after arrest, if:
1717 (1) the use of force would have been justified under
1818 Subsection (a);
1919 (2) the person to be arrested or attempting to escape
2020 after arrest possesses a deadly weapon; and
2121 (3) [:
2222 [(1)] the peace officer [actor] reasonably believes:
2323 (A) the conduct for which arrest is authorized
2424 included the use or attempted use of deadly force; or
2525 (B) [(2) the actor reasonably believes] there is
2626 a substantial risk that the person to be arrested or attempting to
2727 escape after arrest will cause death or serious bodily injury to the
2828 actor or another if the arrest or apprehension is delayed.
2929 (d) A person who is not [other than] a peace officer but is
3030 acting in a peace officer's presence and at the officer's [his]
3131 direction is justified in using deadly force against another when
3232 and to the degree the person reasonably believes the deadly force is
3333 immediately necessary to make a lawful arrest, or to prevent escape
3434 after a lawful arrest, if:
3535 (1) the use of force would have been justified under
3636 Subsection (b);
3737 (2) the person to be arrested or attempting to escape
3838 after arrest possesses a deadly weapon; and
3939 (3) [:
4040 [(1)] the actor reasonably believes:
4141 (A) the felony or offense against the public
4242 peace for which arrest is authorized included the use or attempted
4343 use of deadly force; or
4444 (B) [(2) the actor reasonably believes] there
4545 is a substantial risk that the person to be arrested or attempting
4646 to escape after arrest will cause death or serious bodily injury to
4747 another if the arrest or apprehension is delayed.
4848 SECTION 2. The change in law made by this Act applies only
4949 to an offense committed on or after the effective date of this Act.
5050 An offense committed before the effective date of this Act is
5151 governed by the law in effect on the date the offense was committed,
5252 and the former law is continued in effect for that purpose. For
5353 purposes of this section, an offense was committed before the
5454 effective date of this Act if any element of the offense occurred
5555 before that date.
5656 SECTION 3. This Act takes effect September 1, 2025.
