8	8	AN ACT
9	9	relating to the allocation of certain constitutional transfers of
10	10	money to the economic stabilization fund, the state highway fund,
11	11	and the Grow Texas fund and to the permissible uses of money
12	12	deposited to the Grow Texas fund.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. The heading to Subchapter H, Chapter 316,
15	15	Government Code, is amended to read as follows:
16	16	SUBCHAPTER H. ALLOCATION OF CONSTITUTIONAL TRANSFERS TO CERTAIN
17	17	FUNDS [ECONOMIC STABILIZATION FUND AND STATE HIGHWAY FUND]
18	18	SECTION 2. The heading to Section 316.092, Government Code,
19	19	is amended to read as follows:
20	20	Sec. 316.092. DETERMINATION OF THRESHOLD FOR
21	21	CONSTITUTIONAL TRANSFER TO CERTAIN FUNDS [STATE HIGHWAY FUND].
22	22	SECTION 3. The heading to Section 316.093, Government Code,
23	23	is amended to read as follows:
24	24	Sec. 316.093. ADJUSTMENT OF CONSTITUTIONAL ALLOCATIONS TO
25	25	CERTAIN FUNDS [FUND AND STATE HIGHWAY FUND].
26	26	SECTION 4. Section 316.093, Government Code, is amended by
27	27	amending Subsections (a), (b), and (d) and adding Subsection (e) to
28	28	read as follows:
29	29	(a) Before the comptroller makes transfers for a state
30	30	fiscal year in accordance with Section 49-g(c), Article III, Texas
31	31	Constitution, the comptroller shall determine whether the sum of
32	32	the balance of the fund on the preceding August 31, any projected
33	33	transfer to the fund under Section 49-g(b) of that article, [and]
34	34	any projected transfer to the fund under Section 49-g(c) of that
35	35	article in accordance with the allocations for the transfer as
36	36	provided by Section 49-g(c-1) of that article, and any increase in
37	37	the projected amount of the allocation to the fund under Section
38	38	49-g(c-2) of that article as provided by Subsection (c) of this
39	39	section is less than the amount determined under Section 316.092
40	40	for that state fiscal biennium.
41	41	(b) If the sum described by Subsection (a) is less than the
42	42	amount determined under Section 316.092 for that state fiscal
43	43	biennium, the comptroller shall reduce proportionately the amount
44	44	allocated [allocation] to the state highway fund provided by
45	45	Section 49-g(c-1) [49-g(c)], Article III, Texas Constitution, and
46	46	the amount by which the transfer to the economic stabilization fund
47	47	under that subsection is reduced and a corresponding amount is
48	48	transferred to the Grow Texas fund as provided by Section 49-g(c-3)
49	49	of that article, and increase the allocation to the economic
50	50	stabilization fund[,] in an [equal] amount equal to the reduction
51	51	of those amounts[,] until the amount determined under Section
52	52	316.092 for that state fiscal biennium would be achieved by the
53	53	transfer to the fund or the total amount of the sum described by
54	54	Section 49-g(c), Article III, Texas Constitution, is allocated to
55	55	the fund, whichever occurs first. This subsection expires December
56	56	31, 2042.
57	57	(d) The adjustment required of the comptroller under
58	58	Subsection (c) does not increase the amount by which the allocation
59	59	to the economic stabilization fund is reduced and a corresponding
60	60	amount is transferred to the Grow Texas fund under Section
61	61	49-g(c-3), Article III, Texas Constitution. [Subsections (a) and
62	62	(b) and this subsection expire December 31, 2042.]
63	63	(e) If the sum described by Subsection (a) is less than the
64	64	amount determined under Section 316.092 for a state fiscal biennium
65	65	beginning on or after September 1, 2043, the comptroller shall
66	66	reduce the amount by which the transfer to the economic
67	67	stabilization fund under Section 49-g(c), Article III, Texas
68	68	Constitution, is reduced and a corresponding amount is transferred
69	69	to the Grow Texas fund as provided by Section 49-g(c-3) of that
70	70	article and increase the allocation to the economic stabilization
71	71	fund in an amount equal to the reduction of those amounts until the
72	72	amount determined under Section 316.092 for that state fiscal
73	73	biennium would be achieved by the transfer to the fund or the total
74	74	amount of the sum described by Section 49-g(c), Article III, Texas
75	75	Constitution, is allocated to the fund, whichever occurs first.
76	76	SECTION 5. Subchapter G, Chapter 403, Government Code, is
77	77	amended by adding Section 403.108 to read as follows:
78	78	Sec. 403.108. GROW TEXAS GRANT PROGRAM. (a) In this
79	79	section:
80	80	(1) "Commission" means the Grow Texas fund commission
81	81	created under Section 49-g-1(e), Article III, Texas Constitution.
82	82	(2) "Fund" means the Grow Texas fund established under
83	83	Section 49-g-1(a), Article III, Texas Constitution.
84	84	(b) The legislature may appropriate money in the fund to the
85	85	comptroller for the purpose of funding grants to applicants
86	86	selected by the commission under the program established under
87	87	Subsection (c).
88	88	(c) The comptroller and the commission shall jointly
89	89	establish a program under which the commission may select
90	90	applicants to receive grants provided by the comptroller to
91	91	construct or maintain roads, schools, health care facilities, and
92	92	other infrastructure in the areas of this state the commission
93	93	determines to be significantly affected by oil and gas production.
94	94	(d) The commission shall establish:
95	95	(1) eligibility criteria for grant applicants;
96	96	(2) guidelines relating to grant amounts; and
97	97	(3) procedures for evaluating and approving or denying
98	98	grant applications.
99	99	(e) The comptroller shall:
100	100	(1) establish the procedure for applying for a grant;
101	101	(2) adopt a form that must be used by an applicant to
102	102	apply for a grant; and
103	103	(3) establish procedures for monitoring the use of a
104	104	grant provided under the program and ensuring compliance with any
105	105	conditions of a grant.
106	106	(f) The comptroller shall adopt rules to implement and
107	107	administer this section.
108	108	SECTION 6. Section 316.092(b), Government Code, is
109	109	repealed.
110	110	SECTION 7. This Act takes effect September 1, 2027, but only
111	111	if the constitutional amendment proposed by the 89th Legislature,
112	112	Regular Session, 2025, providing for the creation of and use of
113	113	money in the Grow Texas fund and allocating certain general
114	114	revenues to that fund, the economic stabilization fund, and the
115	115	state highway fund is approved by the voters. If that amendment is
116	116	not approved by the voters, this Act has no effect.
