77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prohibited performance of certain procedures
1010 affecting cat claw functioning; providing a civil penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 821, Health and Safety
1313 Code, is amended by adding Section 821.005 to read as follows:
1414 Sec. 821.005. PROHIBITION ON CERTAIN PROCEDURES PERFORMED
1515 ON CATS; CIVIL PENALTY. (a) Except as provided by Subsections (b)
1616 and (c), a person may not perform a procedure on a cat that prevents
1717 the normal functioning of a claw of the cat, including:
1818 (1) an onychectomy;
1919 (2) a dactylectomy;
2020 (3) a phalangectomy;
2121 (4) a tendonectomy;
2222 (5) a procedure that removes a portion of the cat's paw
2323 or digit to remove the claw; or
2424 (6) a procedure that cuts or modifies the tendon of the
2525 cat's limb, paw, or digit to inhibit normal movement of the claw.
2626 (b) A procedure prohibited by Subsection (a) does not
2727 include nail filing, nail trimming, or the placement of temporary
2828 nail caps on a claw of a cat.
2929 (c) A person may perform a procedure described by Subsection
3030 (a) if:
3131 (1) the procedure:
3232 (A) addresses an existing or recurring
3333 infection, disease, injury, or abnormal condition in the cat's paw,
3434 nail bed, or toe bone that jeopardizes the cat's health; and
3535 (B) is medically necessary for the cat's health
3636 as documented by a licensed veterinarian; or
3737 (2) the procedure is performed to protect the life or
3838 health of a cat's owner, or a member of the owner's household, who
3939 has been diagnosed by a licensed physician as having an infection,
4040 disease, or similar condition that could reasonably be expected to
4141 worsen if the cat scratches the owner or household member.
4242 (d) A person who violates this section is subject to a civil
4343 penalty of $500 for each violation. The attorney general may bring
4444 an action to recover the civil penalty.
4545 SECTION 2. This Act takes effect September 1, 2025.
