11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 1049.052, Special District Local Laws |
---|
13 | 13 | | Code, is amended to read as follows: |
---|
14 | 14 | | Sec. 1049.052. QUALIFICATIONS FOR OFFICE. (a) To qualify |
---|
15 | 15 | | for election to the board, a person must: |
---|
16 | 16 | | (1) be at least 18 years of age; and |
---|
17 | 17 | | (2) have been a district resident for at least one year |
---|
18 | 18 | | [two years; and |
---|
19 | 19 | | [(3) be a qualified property tax paying voter of the |
---|
20 | 20 | | district]. |
---|
21 | 21 | | (b) A person is not eligible to serve as a director if the |
---|
22 | 22 | | person is a district employee. |
---|
23 | 23 | | SECTION 2. Section 1049.053, Special District Local Laws |
---|
24 | 24 | | Code, is amended to read as follows: |
---|
25 | 25 | | Sec. 1049.053. [BOND;] RECORD OF [BOND AND] OATH OR |
---|
26 | 26 | | AFFIRMATION OF OFFICE. (a) Each director shall qualify for office |
---|
27 | 27 | | by taking the official oath of office and subscribing to the |
---|
28 | 28 | | anti-bribery statement required by Section 1, Article XVI, Texas |
---|
29 | 29 | | Constitution [executing a good and sufficient commercial bond for |
---|
30 | 30 | | $1,000 that is: |
---|
31 | 31 | | [(1) payable to the district; and |
---|
32 | 32 | | [(2) conditioned on the faithful performance of the |
---|
33 | 33 | | director's duties]. |
---|
34 | 34 | | (b) [The district shall pay for a director's bond. |
---|
35 | 35 | | [(c)] Each director's [bond and] constitutional oath or |
---|
36 | 36 | | affirmation of office and anti-bribery statement shall be |
---|
37 | 37 | | maintained indefinitely in [deposited with] the district's records |
---|
38 | 38 | | [depository for safekeeping]. |
---|
39 | 39 | | SECTION 3. Section 1049.104, Special District Local Laws |
---|
40 | 40 | | Code, is amended to read as follows: |
---|
41 | 41 | | Sec. 1049.104. HOSPITAL SYSTEM. (a) The district has the |
---|
42 | 42 | | responsibility to establish a hospital or hospital system within |
---|
43 | 43 | | its boundaries to provide hospital and medical care to the |
---|
44 | 44 | | district's residents. |
---|
45 | 45 | | (b) The hospital system may include: |
---|
46 | 46 | | (1) domiciliary care and treatment of sick, injured, |
---|
47 | 47 | | or elderly persons; |
---|
48 | 48 | | (2) outpatient clinics; |
---|
49 | 49 | | (3) pharmacies or other dispensaries; |
---|
50 | 50 | | (4) skilled nursing facilities; |
---|
51 | 51 | | (5) community health centers; |
---|
52 | 52 | | (6) assisted living facilities; and |
---|
53 | 53 | | (7) any other facilities the board considers necessary |
---|
54 | 54 | | for hospital or medical care. |
---|
55 | 55 | | SECTION 4. Section 1049.105(a), Special District Local Laws |
---|
56 | 56 | | Code, is amended to read as follows: |
---|
57 | 57 | | (a) The board may [shall] adopt rules for the efficient |
---|
58 | 58 | | operation of the district[, including district facilities]. |
---|
59 | 59 | | SECTION 5. Section 1049.151, Special District Local Laws |
---|
60 | 60 | | Code, is amended to read as follows: |
---|
61 | 61 | | Sec. 1049.151. BUDGET. (a) The board shall prepare an |
---|
62 | 62 | | annual [a] budget that includes: |
---|
63 | 63 | | (1) proposed expenditures and disbursements; |
---|
64 | 64 | | (2) estimated receipts and collections for the next |
---|
65 | 65 | | fiscal year; and |
---|
66 | 66 | | (3) the amount of taxes required to be imposed to meet |
---|
67 | 67 | | the proposed budget. |
---|
68 | 68 | | (b) The board may delegate the duty to prepare a budget to |
---|
69 | 69 | | another person. |
---|
70 | 70 | | SECTION 6. The heading to Section 1049.152, Special |
---|
71 | 71 | | District Local Laws Code, is amended to read as follows: |
---|
72 | 72 | | Sec. 1049.152. PROPOSED BUDGET: NOTICE; [AND] HEARING; |
---|
73 | 73 | | ADOPTION. |
---|
74 | 74 | | SECTION 7. Section 1049.152, Special District Local Laws |
---|
75 | 75 | | Code, is amended by adding Subsections (d) and (e) to read as |
---|
76 | 76 | | follows: |
---|
77 | 77 | | (d) The board may make a change to the proposed budget at the |
---|
78 | 78 | | hearing. |
---|
79 | 79 | | (e) At the conclusion of the hearing, the board shall adopt |
---|
80 | 80 | | a budget by acting on the proposed budget. |
---|
81 | 81 | | SECTION 8. Subchapter D, Chapter 1049, Special District |
---|
82 | 82 | | Local Laws Code, is amended by adding Section 1049.1525 to read as |
---|
83 | 83 | | follows: |
---|
84 | 84 | | Sec. 1049.1525. AMENDMENT OF BUDGET. The board may amend a |
---|
85 | 85 | | budget after it has been adopted. |
---|
86 | 86 | | SECTION 9. Section 1049.153, Special District Local Laws |
---|
87 | 87 | | Code, is amended to read as follows: |
---|
88 | 88 | | Sec. 1049.153. FISCAL YEAR. (a) The board may establish |
---|
89 | 89 | | the [The] district's fiscal year [is from October 1 to September |
---|
90 | 90 | | 30]. |
---|
91 | 91 | | (b) The district's fiscal year may not be changed: |
---|
92 | 92 | | (1) during a period in which district revenue bonds |
---|
93 | 93 | | are outstanding; or |
---|
94 | 94 | | (2) more than once in a 24-month period. |
---|
95 | 95 | | SECTION 10. Section 1049.155, Special District Local Laws |
---|
96 | 96 | | Code, is amended to read as follows: |
---|
97 | 97 | | Sec. 1049.155. DEPOSITORY. (a) The board by resolution |
---|
98 | 98 | | shall designate a bank in this state [Kimble County] as the |
---|
99 | 99 | | district's depository. A designated bank serves as the district's |
---|
100 | 100 | | depository: |
---|
101 | 101 | | (1) for a period not to exceed five [two] years, as |
---|
102 | 102 | | stated in the designation; and |
---|
103 | 103 | | (2) until a successor is designated. |
---|
104 | 104 | | (b) All district money, other than money invested in |
---|
105 | 105 | | accordance with Chapter 2256, Government Code, shall be deposited |
---|
106 | 106 | | in the depository and secured in accordance with Chapter 2257, |
---|
107 | 107 | | Government Code [in the manner provided for securing county funds]. |
---|
108 | 108 | | (c) Before the board designates a bank to serve as the |
---|
109 | 109 | | district's depository under Subsection (a), the board shall solicit |
---|
110 | 110 | | bids from eligible banks to determine which bank to designate as the |
---|
111 | 111 | | district's depository. |
---|
112 | 112 | | (d) In designating as the district's depository a bank from |
---|
113 | 113 | | among the banks that submitted bids in response to a solicitation |
---|
114 | 114 | | under Subsection (c), the board shall consider criteria adopted by |
---|
115 | 115 | | the board, including: |
---|
116 | 116 | | (1) the level of service offered by the bank; |
---|
117 | 117 | | (2) the return on short-term and long-term funds by |
---|
118 | 118 | | the bank; and |
---|
119 | 119 | | (3) the cost of bank services. |
---|
120 | 120 | | SECTION 11. Sections 1049.105(b) and 1049.154(b), Special |
---|
121 | 121 | | District Local Laws Code, are repealed. |
---|
122 | 122 | | SECTION 12. This Act takes effect immediately if it |
---|
123 | 123 | | receives a vote of two-thirds of all the members elected to each |
---|
124 | 124 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
125 | 125 | | If this Act does not receive the vote necessary for immediate |
---|
126 | 126 | | effect, this Act takes effect September 1, 2025. |
---|
