77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the Kimble County Hospital District of Kimble County,
1010 Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1049.052, Special District Local Laws
1313 Code, is amended to read as follows:
1414 Sec. 1049.052. QUALIFICATIONS FOR OFFICE. (a) To qualify
1515 for election to the board, a person must:
1616 (1) be at least 18 years of age; and
1717 (2) have been a district resident for at least one year
1818 [two years; and
1919 [(3) be a qualified property tax paying voter of the
2020 district].
2121 (b) A person is not eligible to serve as a director if the
2222 person is a district employee.
2323 SECTION 2. Section 1049.053, Special District Local Laws
2424 Code, is amended to read as follows:
2525 Sec. 1049.053. [BOND;] RECORD OF [BOND AND] OATH OR
2626 AFFIRMATION OF OFFICE. (a) Each director shall qualify for office
2727 by taking the official oath of office and subscribing to the
2828 anti-bribery statement required by Section 1, Article XVI, Texas
2929 Constitution [executing a good and sufficient commercial bond for
3030 $1,000 that is:
3131 [(1) payable to the district; and
3232 [(2) conditioned on the faithful performance of the
3333 director's duties].
3434 (b) [The district shall pay for a director's bond.
3535 [(c)] Each director's [bond and] constitutional oath or
3636 affirmation of office and anti-bribery statement shall be
3737 maintained indefinitely in [deposited with] the district's records
3838 [depository for safekeeping].
3939 SECTION 3. Section 1049.104, Special District Local Laws
4040 Code, is amended to read as follows:
4141 Sec. 1049.104. HOSPITAL SYSTEM. (a) The district has the
4242 responsibility to establish a hospital or hospital system within
4343 its boundaries to provide hospital and medical care to the
4444 district's residents.
4545 (b) The hospital system may include:
4646 (1) domiciliary care and treatment of sick, injured,
4747 or elderly persons;
4848 (2) outpatient clinics;
4949 (3) pharmacies or other dispensaries;
5050 (4) skilled nursing facilities;
5151 (5) community health centers;
5252 (6) assisted living facilities; and
5353 (7) any other facilities the board considers necessary
5454 for hospital or medical care.
5555 SECTION 4. Section 1049.105(a), Special District Local Laws
5656 Code, is amended to read as follows:
5757 (a) The board may [shall] adopt rules for the efficient
5858 operation of the district[, including district facilities].
5959 SECTION 5. Section 1049.151, Special District Local Laws
6060 Code, is amended to read as follows:
6161 Sec. 1049.151. BUDGET. (a) The board shall prepare an
6262 annual [a] budget that includes:
6363 (1) proposed expenditures and disbursements;
6464 (2) estimated receipts and collections for the next
6565 fiscal year; and
6666 (3) the amount of taxes required to be imposed to meet
6767 the proposed budget.
6868 (b) The board may delegate the duty to prepare a budget to
6969 another person.
7070 SECTION 6. The heading to Section 1049.152, Special
7171 District Local Laws Code, is amended to read as follows:
7272 Sec. 1049.152. PROPOSED BUDGET: NOTICE; [AND] HEARING;
7373 ADOPTION.
7474 SECTION 7. Section 1049.152, Special District Local Laws
7575 Code, is amended by adding Subsections (d) and (e) to read as
7676 follows:
7777 (d) The board may make a change to the proposed budget at the
7878 hearing.
7979 (e) At the conclusion of the hearing, the board shall adopt
8080 a budget by acting on the proposed budget.
8181 SECTION 8. Subchapter D, Chapter 1049, Special District
8282 Local Laws Code, is amended by adding Section 1049.1525 to read as
8383 follows:
8484 Sec. 1049.1525. AMENDMENT OF BUDGET. The board may amend a
8585 budget after it has been adopted.
8686 SECTION 9. Section 1049.153, Special District Local Laws
8787 Code, is amended to read as follows:
8888 Sec. 1049.153. FISCAL YEAR. (a) The board may establish
8989 the [The] district's fiscal year [is from October 1 to September
9090 30].
9191 (b) The district's fiscal year may not be changed:
9292 (1) during a period in which district revenue bonds
9393 are outstanding; or
9494 (2) more than once in a 24-month period.
9595 SECTION 10. Section 1049.155, Special District Local Laws
9696 Code, is amended to read as follows:
9797 Sec. 1049.155. DEPOSITORY. (a) The board by resolution
9898 shall designate a bank in this state [Kimble County] as the
9999 district's depository. A designated bank serves as the district's
100100 depository:
101101 (1) for a period not to exceed five [two] years, as
102102 stated in the designation; and
103103 (2) until a successor is designated.
104104 (b) All district money, other than money invested in
105105 accordance with Chapter 2256, Government Code, shall be deposited
106106 in the depository and secured in accordance with Chapter 2257,
107107 Government Code [in the manner provided for securing county funds].
108108 (c) Before the board designates a bank to serve as the
109109 district's depository under Subsection (a), the board shall solicit
110110 bids from eligible banks to determine which bank to designate as the
111111 district's depository.
112112 (d) In designating as the district's depository a bank from
113113 among the banks that submitted bids in response to a solicitation
114114 under Subsection (c), the board shall consider criteria adopted by
115115 the board, including:
116116 (1) the level of service offered by the bank;
117117 (2) the return on short-term and long-term funds by
118118 the bank; and
119119 (3) the cost of bank services.
120120 SECTION 11. Sections 1049.105(b) and 1049.154(b), Special
121121 District Local Laws Code, are repealed.
122122 SECTION 12. This Act takes effect immediately if it
123123 receives a vote of two-thirds of all the members elected to each
124124 house, as provided by Section 39, Article III, Texas Constitution.
125125 If this Act does not receive the vote necessary for immediate
126126 effect, this Act takes effect September 1, 2025.
