| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 261.1055, Family Code, is amended to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | Sec. 261.1055. NOTIFICATION AND RELEASE OF CERTAIN |
|---|
| 16 | 16 | | INFORMATION TO COUNTY OR DISTRICT ATTORNEYS. (a) The [A district |
|---|
| 17 | 17 | | attorney may inform the department that the district attorney |
|---|
| 18 | 18 | | wishes to receive notification of some or all reports of suspected |
|---|
| 19 | 19 | | abuse or neglect of children who were in the county at the time the |
|---|
| 20 | 20 | | report was made or who were in the county at the time of the alleged |
|---|
| 21 | 21 | | abuse or neglect. |
|---|
| 22 | 22 | | [(b) If the district attorney makes the notification under |
|---|
| 23 | 23 | | this section, the] department shall, on receipt of a report of |
|---|
| 24 | 24 | | suspected abuse or neglect, immediately notify a county or [the] |
|---|
| 25 | 25 | | district attorney with jurisdiction to investigate or prosecute the |
|---|
| 26 | 26 | | reported abuse or neglect of the report. |
|---|
| 27 | 27 | | (b) On request by the county or district attorney, [as |
|---|
| 28 | 28 | | requested and] the department shall forward a copy of the report of |
|---|
| 29 | 29 | | abuse or neglect and all information concerning the investigation |
|---|
| 30 | 30 | | of the reported abuse or neglect, including information that is |
|---|
| 31 | 31 | | confidential under Section 261.201, [reports] to the county or |
|---|
| 32 | 32 | | district attorney [on request]. |
|---|
| 33 | 33 | | (c) The information released by the department to a county |
|---|
| 34 | 34 | | or district attorney under Subsection (b) is not subject to public |
|---|
| 35 | 35 | | release by the county or district attorney under Chapter 552, |
|---|
| 36 | 36 | | Government Code, and may only be disclosed for purposes consistent |
|---|
| 37 | 37 | | with Articles 39.14, 39.15, and 39.151, Code of Criminal Procedure. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2025. |
