77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the punishment for the offense of arson involving a
1010 government building.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 28.02(d), Penal Code, is amended to read
1313 as follows:
1414 (d) An offense under Subsection (a) is a felony of the
1515 second degree, except that the offense is a felony of the first
1616 degree if it is shown on the trial of the offense that:
1717 (1) bodily injury or death was suffered by any person
1818 by reason of the commission of the offense; or
1919 (2) the property intended to be damaged or destroyed
2020 by the actor was a:
2121 (A) government building;
2222 (B) habitation; or
2323 (C) [a] place of assembly or worship.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect on the date the offense was committed,
2828 and the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense occurred
3131 before that date.
3232 SECTION 3. This Act takes effect September 1, 2025.
