77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the repeal of certain provisions authorizing cemeteries
1010 in certain municipalities and counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 711.008(a), Health and Safety Code, is
1313 amended to read as follows:
1414 (a) Except as provided by Subsections (b), (f), (g), (g-1),
1515 (g-2), [(g-3), (g-4),] (h), (k), and (m), an individual,
1616 corporation, partnership, firm, trust, or association may not
1717 establish or operate a cemetery, or use any land for the interment
1818 of remains, located:
1919 (1) in or within one mile of the boundaries of a
2020 municipality with a population of 5,000 to 25,000;
2121 (2) in or within two miles of the boundaries of a
2222 municipality with a population of 25,000 to 50,000;
2323 (3) in or within three miles of the boundaries of a
2424 municipality with a population of 50,000 to 100,000;
2525 (4) in or within four miles of the boundaries of a
2626 municipality with a population of 100,000 to 200,000; or
2727 (5) in or within five miles of the boundaries of a
2828 municipality with a population of at least 200,000.
2929 SECTION 2. Sections 711.008(g-3) and (g-4), Health and
3030 Safety Code, are repealed.
3131 SECTION 3. This Act takes effect September 1, 2025.
