7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to abnormal skin growth education for certain occupational
10	10	license holders and to the liability of those license holders and
11	11	their employers for certain medical referrals.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subchapter D, Chapter 201, Occupations Code, is
14	14	amended by adding Section 201.165 to read as follows:
15	15	Sec. 201.165. COURSEWORK IN ABNORMAL SKIN GROWTH. (a) The
16	16	board by rule shall approve coursework in abnormal skin growth for
17	17	purposes of Section 201.357.
18	18	(b) Coursework approved under Subsection (a) must include
19	19	training in identifying melanoma.
20	20	(c) An entity approved by the board to provide coursework
21	21	under Subsection (a) shall issue a certificate of completion to
22	22	each individual who successfully completes the coursework.
23	23	SECTION 2. Subchapter H, Chapter 201, Occupations Code, is
24	24	amended by adding Section 201.357 to read as follows:
25	25	Sec. 201.357. COMPLETION OF ABNORMAL SKIN GROWTH COURSEWORK
26	26	REQUIRED. (a) Except as provided by Subsection (b), the board may
27	27	not issue an initial or renewal license to a person under this
28	28	chapter unless the person completes a course approved by the board
29	29	under Section 201.165 in abnormal skin growth education, including
30	30	training on identifying melanoma. Each applicant for issuance or,
31	31	if applicable, renewal of a license must provide proof of
32	32	completion of the course.
33	33	(b) A person who satisfies the requirements of Subsection
34	34	(a) is not required to complete additional coursework described by
35	35	that subsection for the subsequent renewal of that person's
36	36	license.
37	37	SECTION 3. Subchapter J, Chapter 201, Occupations Code, is
38	38	amended by adding Section 201.454 to read as follows:
39	39	Sec. 201.454. REFERRAL TO MEDICAL PROFESSIONAL REGARDING
40	40	ABNORMAL SKIN GROWTH; LICENSE HOLDER AND EMPLOYER LIABILITY. (a) A
41	41	person licensed under this chapter who has completed coursework
42	42	approved by the board under Section 201.165 may refer an individual
43	43	to seek care from a medical professional regarding an abnormal skin
44	44	growth.
45	45	(b) A person licensed under this chapter who has completed
46	46	coursework approved by the board under Section 201.165 or the
47	47	person's employer may not be civilly or criminally liable for
48	48	acting in good faith or for failing to act on information obtained
49	49	during the course of practicing the person's profession or acting
50	50	within the scope of the person's employment concerning potential
51	51	abnormal skin growths.
52	52	(c) This section may not be construed to create a cause of
53	53	action or civil liability or to require or authorize a person
54	54	licensed under this chapter to practice medicine or otherwise
55	55	practice outside of the license holder's scope of practice.
56	56	SECTION 4. Subchapter B, Chapter 455, Occupations Code, is
57	57	amended by adding Section 455.060 to read as follows:
58	58	Sec. 455.060. COURSEWORK IN ABNORMAL SKIN GROWTH. (a) The
59	59	commission by rule shall approve coursework in abnormal skin growth
60	60	for purposes of Section 455.162.
61	61	(b) Coursework approved under Subsection (a) must include
62	62	training in identifying melanoma.
63	63	(c) An entity approved by the commission to provide
64	64	coursework under Subsection (a) shall issue a certificate of
65	65	completion to each individual who successfully completes the
66	66	coursework.
67	67	SECTION 5. Subchapter D, Chapter 455, Occupations Code, is
68	68	amended by adding Section 455.162 to read as follows:
69	69	Sec. 455.162. COMPLETION OF ABNORMAL SKIN GROWTH COURSEWORK
70	70	REQUIRED. (a) Except as provided by Subsection (b), the commission
71	71	may not issue an initial or renewal license to a person under this
72	72	chapter unless the person completes a course approved by the
73	73	commission under Section 455.060 in abnormal skin growth education,
74	74	including training on identifying melanoma. Each applicant for
75	75	issuance or, if applicable, renewal of a license must provide proof
76	76	of completion of the course.
77	77	(b) A person who satisfies the requirements of Subsection

84	84	ABNORMAL SKIN GROWTH; LICENSE HOLDER AND EMPLOYER LIABILITY. (a) A
85	85	person licensed under this chapter who has completed coursework
86	86	approved by the commission under Section 455.060 may refer an

88	88	abnormal skin growth.

100	100	SECTION 7. Subchapter C, Chapter 1603, Occupations Code, is
101	101	amended by adding Section 1603.107 to read as follows:
102	102	Sec. 1603.107. COURSEWORK IN ABNORMAL SKIN GROWTH. (a) The
103	103	commission by rule shall approve coursework in abnormal skin growth
104	104	for purposes of Section 1603.2110.
105	105	(b) Coursework approved under Subsection (a) must include
106	106	training in identifying melanoma.
107	107	(c) An entity approved by the commission to provide
108	108	coursework under Subsection (a) shall issue a certificate of
109	109	completion to each individual who successfully completes the
110	110	coursework.
111	111	SECTION 8. Subchapter E-1, Chapter 1603, Occupations Code,
112	112	is amended by adding Sections 1603.2110 and 1603.2111 to read as
113	113	follows:
114	114	Sec. 1603.2110. COMPLETION OF ABNORMAL SKIN GROWTH
115	115	COURSEWORK REQUIRED. (a) Except as provided by Subsection (b), the
116	116	commission may not issue an initial or renewal individual
117	117	practitioner license to a person under this chapter unless the
118	118	person completes a course approved by the commission under Section
119	119	1603.107 in abnormal skin growth education, including training on
120	120	identifying melanoma. Each applicant for issuance or, if
121	121	applicable, renewal of a license must provide proof of completion
122	122	of the course.
123	123	(b) A person who satisfies the requirements of Subsection
124	124	(a) is not required to complete additional coursework described by
125	125	that subsection for the subsequent renewal of that person's
126	126	license.
127	127	Sec. 1603.2111. REFERRAL TO MEDICAL PROFESSIONAL REGARDING

130	130	approved by the commission under Section 1603.107 may refer an

144	144	SECTION 9. Not later than December 1, 2025, the Texas Board
145	145	of Chiropractic Examiners and the Texas Commission of Licensing and
146	146	Regulation shall adopt the rules necessary to implement this Act.
147	147	SECTION 10. Sections 201.357, 455.162, and 1603.2110,
148	148	Occupations Code, as added by this Act, apply only to the issuance
149	149	of a license for which an application was submitted on or after
150	150	June 1, 2026, or to the renewal of a license that expires on or after
151	151	that date. The issuance of a license for which an application was
152	152	submitted before June 1, 2026, or the renewal of a license that
153	153	expires before that date is governed by the law in effect on the
154	154	date the application was submitted or the license expired, and the
155	155	former law is continued in effect for that purpose.
156	156	SECTION 11. This Act takes effect September 1, 2025.
