77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to abnormal skin growth education for certain occupational
1010 license holders and to the liability of those license holders and
1111 their employers for certain medical referrals.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter D, Chapter 201, Occupations Code, is
1414 amended by adding Section 201.165 to read as follows:
1515 Sec. 201.165. COURSEWORK IN ABNORMAL SKIN GROWTH. (a) The
1616 board by rule shall approve coursework in abnormal skin growth for
1717 purposes of Section 201.357.
1818 (b) Coursework approved under Subsection (a) must include
1919 training in identifying melanoma.
2020 (c) An entity approved by the board to provide coursework
2121 under Subsection (a) shall issue a certificate of completion to
2222 each individual who successfully completes the coursework.
2323 SECTION 2. Subchapter H, Chapter 201, Occupations Code, is
2424 amended by adding Section 201.357 to read as follows:
2525 Sec. 201.357. COMPLETION OF ABNORMAL SKIN GROWTH COURSEWORK
2626 REQUIRED. (a) Except as provided by Subsection (b), the board may
2727 not issue an initial or renewal license to a person under this
2828 chapter unless the person completes a course approved by the board
2929 under Section 201.165 in abnormal skin growth education, including
3030 training on identifying melanoma. Each applicant for issuance or,
3131 if applicable, renewal of a license must provide proof of
3232 completion of the course.
3333 (b) A person who satisfies the requirements of Subsection
3434 (a) is not required to complete additional coursework described by
3535 that subsection for the subsequent renewal of that person's
3636 license.
3737 SECTION 3. Subchapter J, Chapter 201, Occupations Code, is
3838 amended by adding Section 201.454 to read as follows:
3939 Sec. 201.454. REFERRAL TO MEDICAL PROFESSIONAL REGARDING
4040 ABNORMAL SKIN GROWTH; LICENSE HOLDER AND EMPLOYER LIABILITY. (a) A
4141 person licensed under this chapter who has completed coursework
4242 approved by the board under Section 201.165 may refer an individual
4343 to seek care from a medical professional regarding an abnormal skin
4444 growth.
4545 (b) A person licensed under this chapter who has completed
4646 coursework approved by the board under Section 201.165 or the
4747 person's employer may not be civilly or criminally liable for
4848 acting in good faith or for failing to act on information obtained
4949 during the course of practicing the person's profession or acting
5050 within the scope of the person's employment concerning potential
5151 abnormal skin growths.
5252 (c) This section may not be construed to create a cause of
5353 action or civil liability or to require or authorize a person
5454 licensed under this chapter to practice medicine or otherwise
5555 practice outside of the license holder's scope of practice.
5656 SECTION 4. Subchapter B, Chapter 455, Occupations Code, is
5757 amended by adding Section 455.060 to read as follows:
5858 Sec. 455.060. COURSEWORK IN ABNORMAL SKIN GROWTH. (a) The
5959 commission by rule shall approve coursework in abnormal skin growth
6060 for purposes of Section 455.162.
6161 (b) Coursework approved under Subsection (a) must include
6262 training in identifying melanoma.
6363 (c) An entity approved by the commission to provide
6464 coursework under Subsection (a) shall issue a certificate of
6565 completion to each individual who successfully completes the
6666 coursework.
6767 SECTION 5. Subchapter D, Chapter 455, Occupations Code, is
6868 amended by adding Section 455.162 to read as follows:
6969 Sec. 455.162. COMPLETION OF ABNORMAL SKIN GROWTH COURSEWORK
7070 REQUIRED. (a) Except as provided by Subsection (b), the commission
7171 may not issue an initial or renewal license to a person under this
7272 chapter unless the person completes a course approved by the
7373 commission under Section 455.060 in abnormal skin growth education,
7474 including training on identifying melanoma. Each applicant for
7575 issuance or, if applicable, renewal of a license must provide proof
7676 of completion of the course.
7777 (b) A person who satisfies the requirements of Subsection
7878 (a) is not required to complete additional coursework described by
7979 that subsection for the subsequent renewal of that person's
8080 license.
8181 SECTION 6. Subchapter E, Chapter 455, Occupations Code, is
8282 amended by adding Section 455.208 to read as follows:
8383 Sec. 455.208. REFERRAL TO MEDICAL PROFESSIONAL REGARDING
8484 ABNORMAL SKIN GROWTH; LICENSE HOLDER AND EMPLOYER LIABILITY. (a) A
8585 person licensed under this chapter who has completed coursework
8686 approved by the commission under Section 455.060 may refer an
8787 individual to seek care from a medical professional regarding an
8888 abnormal skin growth.
8989 (b) A person licensed under this chapter who has completed
9090 coursework approved by the commission under Section 455.060 or the
9191 person's employer may not be civilly or criminally liable for
9292 acting in good faith or for failing to act on information obtained
9393 during the course of practicing the person's profession or acting
9494 within the scope of the person's employment concerning potential
9595 abnormal skin growths.
9696 (c) This section may not be construed to create a cause of
9797 action or civil liability or to require or authorize a person
9898 licensed under this chapter to practice medicine or otherwise
9999 practice outside of the license holder's scope of practice.
100100 SECTION 7. Subchapter C, Chapter 1603, Occupations Code, is
101101 amended by adding Section 1603.107 to read as follows:
102102 Sec. 1603.107. COURSEWORK IN ABNORMAL SKIN GROWTH. (a) The
103103 commission by rule shall approve coursework in abnormal skin growth
104104 for purposes of Section 1603.2110.
105105 (b) Coursework approved under Subsection (a) must include
106106 training in identifying melanoma.
107107 (c) An entity approved by the commission to provide
108108 coursework under Subsection (a) shall issue a certificate of
109109 completion to each individual who successfully completes the
110110 coursework.
111111 SECTION 8. Subchapter E-1, Chapter 1603, Occupations Code,
112112 is amended by adding Sections 1603.2110 and 1603.2111 to read as
113113 follows:
114114 Sec. 1603.2110. COMPLETION OF ABNORMAL SKIN GROWTH
115115 COURSEWORK REQUIRED. (a) Except as provided by Subsection (b), the
116116 commission may not issue an initial or renewal individual
117117 practitioner license to a person under this chapter unless the
118118 person completes a course approved by the commission under Section
119119 1603.107 in abnormal skin growth education, including training on
120120 identifying melanoma. Each applicant for issuance or, if
121121 applicable, renewal of a license must provide proof of completion
122122 of the course.
123123 (b) A person who satisfies the requirements of Subsection
124124 (a) is not required to complete additional coursework described by
125125 that subsection for the subsequent renewal of that person's
126126 license.
127127 Sec. 1603.2111. REFERRAL TO MEDICAL PROFESSIONAL REGARDING
128128 ABNORMAL SKIN GROWTH; LICENSE HOLDER AND EMPLOYER LIABILITY. (a) A
129129 person licensed under this chapter who has completed coursework
130130 approved by the commission under Section 1603.107 may refer an
131131 individual to seek care from a medical professional regarding an
132132 abnormal skin growth.
133133 (b) A person licensed under this chapter who has completed
134134 coursework approved by the commission under Section 1603.107 or the
135135 person's employer may not be civilly or criminally liable for
136136 acting in good faith or for failing to act on information obtained
137137 during the course of practicing the person's profession or acting
138138 within the scope of the person's employment concerning potential
139139 abnormal skin growths.
140140 (c) This section may not be construed to create a cause of
141141 action or civil liability or to require or authorize a person
142142 licensed under this chapter to practice medicine or otherwise
143143 practice outside of the license holder's scope of practice.
144144 SECTION 9. Not later than December 1, 2025, the Texas Board
145145 of Chiropractic Examiners and the Texas Commission of Licensing and
146146 Regulation shall adopt the rules necessary to implement this Act.
147147 SECTION 10. Sections 201.357, 455.162, and 1603.2110,
148148 Occupations Code, as added by this Act, apply only to the issuance
149149 of a license for which an application was submitted on or after
150150 June 1, 2026, or to the renewal of a license that expires on or after
151151 that date. The issuance of a license for which an application was
152152 submitted before June 1, 2026, or the renewal of a license that
153153 expires before that date is governed by the law in effect on the
154154 date the application was submitted or the license expired, and the
155155 former law is continued in effect for that purpose.
156156 SECTION 11. This Act takes effect September 1, 2025.
