11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter E, Chapter 86, Education Code, is |
---|
13 | 13 | | amended by adding Section 86.83 to read as follows: |
---|
14 | 14 | | Sec. 86.83. INSTITUTE FOR CHRONIC WASTING DISEASE RESEARCH. |
---|
15 | 15 | | (a) In this section: |
---|
16 | 16 | | (1) "Breeder deer," "deer," and "deer breeder" have |
---|
17 | 17 | | the meanings assigned to those terms by Section 43.351, Parks and |
---|
18 | 18 | | Wildlife Code. |
---|
19 | 19 | | (2) "Chronic wasting disease" means a transmissible |
---|
20 | 20 | | spongiform encephalopathy infecting deer and related species and |
---|
21 | 21 | | their hybrids. |
---|
22 | 22 | | (3) "Institute" means the Institute for Chronic |
---|
23 | 23 | | Wasting Disease Research. |
---|
24 | 24 | | (b) The Institute for Chronic Wasting Disease Research is a |
---|
25 | 25 | | component of Texas A&M University. |
---|
26 | 26 | | (c) The institute is under the management and direction of |
---|
27 | 27 | | the board. |
---|
28 | 28 | | (d) The institute may employ personnel. |
---|
29 | 29 | | (e) The institute may accept a gift or grant from any public |
---|
30 | 30 | | or private source for the benefit of the institute. |
---|
31 | 31 | | (f) The institute shall, in partnership with deer breeders: |
---|
32 | 32 | | (1) study the progression of chronic wasting disease; |
---|
33 | 33 | | (2) analyze the genetic profiles of deer infected with |
---|
34 | 34 | | chronic wasting disease; |
---|
35 | 35 | | (3) develop: |
---|
36 | 36 | | (A) strategies to prevent chronic wasting |
---|
37 | 37 | | disease; |
---|
38 | 38 | | (B) efforts to mitigate transmission of chronic |
---|
39 | 39 | | wasting disease; and |
---|
40 | 40 | | (C) treatments for chronic wasting disease; and |
---|
41 | 41 | | (4) evaluate the implementation of strategies, |
---|
42 | 42 | | mitigation efforts, and treatments developed under Subdivision |
---|
43 | 43 | | (3), including for breeder deer. |
---|
44 | 44 | | (g) The institute may conduct an activity described by |
---|
45 | 45 | | Subsection (f) at a location: |
---|
46 | 46 | | (1) for which a deer breeder's permit was issued, at |
---|
47 | 47 | | the deer breeder's request; or |
---|
48 | 48 | | (2) operated by the institute. |
---|
49 | 49 | | (h) A deer breeder who makes available to the institute a |
---|
50 | 50 | | breeder deer for an activity described by Subsection (f) is |
---|
51 | 51 | | entitled to compensation from the institute for: |
---|
52 | 52 | | (1) a breeder deer on which the institute directly |
---|
53 | 53 | | conducts the activity, regardless of the location of the activity; |
---|
54 | 54 | | and |
---|
55 | 55 | | (2) any breeder deer at the deer breeder's permitted |
---|
56 | 56 | | location that the breeder is prohibited from selling, transferring, |
---|
57 | 57 | | or releasing because the institute conducts an activity described |
---|
58 | 58 | | by Subsection (f) at the location. |
---|
59 | 59 | | (i) Notwithstanding any other law, a deer breeder or the |
---|
60 | 60 | | institute may transfer a breeder deer from the location for which |
---|
61 | 61 | | the deer breeder's permit was issued to the institute to conduct an |
---|
62 | 62 | | activity described by Subsection (f). |
---|
63 | 63 | | SECTION 2. The Institute for Chronic Wasting Disease |
---|
64 | 64 | | Research is required to implement a provision of this Act only if |
---|
65 | 65 | | the legislature appropriates money specifically for that purpose. |
---|
66 | 66 | | If the legislature does not appropriate money specifically for that |
---|
67 | 67 | | purpose, the institute may, but is not required to, implement a |
---|
68 | 68 | | provision of this Act using other appropriations available for that |
---|
69 | 69 | | purpose. |
---|
70 | 70 | | SECTION 3. This Act takes effect September 1, 2025. |
