88 AN ACT
99 relating to the creation of the Institute for Chronic Wasting
1010 Disease Research.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 86, Education Code, is
1313 amended by adding Section 86.83 to read as follows:
1414 Sec. 86.83. INSTITUTE FOR CHRONIC WASTING DISEASE RESEARCH.
1515 (a) In this section:
1616 (1) "Breeder deer," "deer," and "deer breeder" have
1717 the meanings assigned to those terms by Section 43.351, Parks and
1818 Wildlife Code.
1919 (2) "Chronic wasting disease" means a transmissible
2020 spongiform encephalopathy infecting deer and related species and
2121 their hybrids.
2222 (3) "Institute" means the Institute for Chronic
2323 Wasting Disease Research.
2424 (b) The Institute for Chronic Wasting Disease Research is a
2525 component of Texas A&M University.
2626 (c) The institute is under the management and direction of
2727 the board.
2828 (d) The institute may employ personnel.
2929 (e) The institute may accept a gift or grant from any public
3030 or private source for the benefit of the institute.
3131 (f) The institute shall, in partnership with deer breeders:
3232 (1) study the progression of chronic wasting disease;
3333 (2) analyze the genetic profiles of deer infected with
3434 chronic wasting disease;
3535 (3) develop:
3636 (A) strategies to prevent chronic wasting
3737 disease;
3838 (B) efforts to mitigate transmission of chronic
3939 wasting disease; and
4040 (C) treatments for chronic wasting disease; and
4141 (4) evaluate the implementation of strategies,
4242 mitigation efforts, and treatments developed under Subdivision
4343 (3), including for breeder deer.
4444 (g) The institute may conduct an activity described by
4545 Subsection (f) at a location:
4646 (1) for which a deer breeder's permit was issued, at
4747 the deer breeder's request; or
4848 (2) operated by the institute.
4949 (h) A deer breeder who makes available to the institute a
5050 breeder deer for an activity described by Subsection (f) is
5151 entitled to compensation from the institute for:
5252 (1) a breeder deer on which the institute directly
5353 conducts the activity, regardless of the location of the activity;
5454 and
5555 (2) any breeder deer at the deer breeder's permitted
5656 location that the breeder is prohibited from selling, transferring,
5757 or releasing because the institute conducts an activity described
5858 by Subsection (f) at the location.
5959 (i) Notwithstanding any other law, a deer breeder or the
6060 institute may transfer a breeder deer from the location for which
6161 the deer breeder's permit was issued to the institute to conduct an
6262 activity described by Subsection (f).
6363 SECTION 2. The Institute for Chronic Wasting Disease
6464 Research is required to implement a provision of this Act only if
6565 the legislature appropriates money specifically for that purpose.
6666 If the legislature does not appropriate money specifically for that
6767 purpose, the institute may, but is not required to, implement a
6868 provision of this Act using other appropriations available for that
6969 purpose.
7070 SECTION 3. This Act takes effect September 1, 2025.
