8 | 8 | | relating to the election, terms, and resignation of the board of |

9 | 9 | | commissioners of the Brazoria Drainage District No. 4. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 7, Chapter 991, Acts of the 74th |
---|
12 | 12 | | Legislature, Regular Session, 1995, is amended by amending |
---|
13 | 13 | | Subsections (a) and (f) and adding Subsection (a-1) to read as |
---|
14 | 14 | | follows: |
---|
15 | 15 | | (a) The district is managed by a board of three |
---|
16 | 16 | | commissioners as provided by Chapter 56, Water Code, and each holds |
---|
17 | 17 | | an elected office designated as Place No. 1, Place No. 2, or Place |
---|
18 | 18 | | No. 3. The board shall call and hold elections for the appropriate |
---|
19 | 19 | | number of commissioners on the uniform election date in May |
---|
20 | 20 | | [November] of each [oven] odd-numbered year. The [Notwithstanding |
---|
21 | 21 | | Section 56.063, Water Code, the] commissioners serve staggered |
---|
22 | 22 | | four-year terms, each beginning June [January] 1 of the year |
---|
23 | 23 | | [following] of the commissioner's election and continuing until the |
---|
24 | 24 | | commissioner's successor in office is elected and has qualified. |
---|
25 | 25 | | (a-1) If a commissioner announces the commissioner's |
---|
26 | 26 | | candidacy, or in fact becomes a candidate, in any general, special, |
---|
27 | 27 | | or primary election for any office of profit or trust under the laws |
---|
28 | 28 | | of this State or the United States other than the office of |
---|
29 | 29 | | commissioner for the district, at any time when the unexpired term |
---|
30 | 30 | | of office then held shall exceed one year and 30 days, such |
---|
31 | 31 | | announcement or candidacy shall constitute an automatic |
---|
32 | 32 | | resignation of the office of the commissioner. |
---|
33 | 33 | | (f) A vacancy in a commissioner's office or other board |
---|
34 | 34 | | office shall be filled by appointment by the remaining |
---|
35 | 35 | | commissioners if less than 290 days remain before the date of the |
---|
36 | 36 | | next regular election of one or more commissioners. [If the |
---|
37 | 37 | | commissioners do not agree on an appointment before the 61st day |
---|
38 | 38 | | after the date the vacancy occurs, the commissioners shall call and |
---|
39 | 39 | | hold a special election to fill the office before the 121st day |
---|
40 | 40 | | after the date the vacancy occurs]. |

41 | 41 | | SECTION 2. Sections 7(b), (c), (d), (e), and (i), Chapter |
---|
42 | 42 | | 991, Acts of the 74th Legislature, Regular Session, 1995, are |
---|
43 | 43 | | repealed. |
---|
44 | 44 | | SECTION 3. (a) The Brazoria Drainage District No. 4 shall |
---|
45 | 45 | | hold the first election to elect commissioners for Place No. 1 and |
---|
46 | 46 | | Place No. 2 as described by Section 7(a), Chapter 991, Acts of the |
---|
47 | 47 | | 74th Legislature, Regular Session, 1995, as amended by this Act, on |
---|
48 | 48 | | the uniform election date in May 2029. |
---|
49 | 49 | | (b) The Brazoria Drainage District No. 4 shall hold the |
---|
50 | 50 | | first election to elect the commissioner for Place No. 3 as |
---|
51 | 51 | | described by Section 7(a), Chapter 991, Acts of the 74th |
---|
52 | 52 | | Legislature, Regular Session, 1995, as amended by this Act, on the |
---|
53 | 53 | | uniform election date in May 2027. |
---|
54 | 54 | | (c) The terms of the commissioners for Place No. 1 and Place |
---|
55 | 55 | | No. 2 serving on the board of commissioners of the Brazoria |
---|
56 | 56 | | Drainage District No. 4 on the effective date of this Act expire on |
---|
57 | 57 | | the later of May 31, 2029, or the date the commissioners elected |
---|
58 | 58 | | under Subsection (a) of this section have qualified. |
---|
59 | 59 | | (d) The term of the commissioner for Place No. 3 serving on |
---|
60 | 60 | | the board of commissioners of the Brazoria Drainage District No. 4 |
---|
61 | 61 | | immediately before the date of the election held under Subsection |
---|
62 | 62 | | (b) of this section expires on the later of May 31, 2027, or the date |
---|
63 | 63 | | the commissioner elected under that subsection has qualified. |
---|
64 | 64 | | SECTION 4. (a) The legal notice of the intention to |
---|
65 | 65 | | introduce this Act, setting forth the general substance of this |
---|
66 | 66 | | Act, has been published as provided by law, and the notice and a |
---|
67 | 67 | | copy of this Act have been furnished to all persons, agencies, |
---|
68 | 68 | | officials, or entities to which they are required to be furnished |
---|
69 | 69 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
70 | 70 | | Government Code. |
---|
71 | 71 | | (b) The governor, one of the required recipients, has |
---|
72 | 72 | | submitted the notice and Act to the Texas Commission on |
---|
73 | 73 | | Environmental Quality. |
---|
74 | 74 | | (c) The Texas Commission on Environmental Quality has filed |
---|
75 | 75 | | its recommendations relating to this Act with the governor, the |
---|
76 | 76 | | lieutenant governor, and the speaker of the house of |
---|
77 | 77 | | representatives within the required time. |
---|
78 | 78 | | (d) All requirements of the constitution and laws of this |
---|
79 | 79 | | state and the rules and procedures of the legislature with respect |
---|
80 | 80 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
81 | 81 | | and accomplished. |
---|
82 | 82 | | SECTION 5. This Act takes effect immediately if it receives |
---|
83 | 83 | | a vote of two-thirds of all the members elected to each house, as |
---|
84 | 84 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
85 | 85 | | Act does not receive the vote necessary for immediate effect, this |
---|
86 | 86 | | Act takes effect September 1, 2025. |
