66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the election, terms, and resignation of the board of
99 commissioners of the Brazoria Drainage District No. 4.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 7, Chapter 991, Acts of the 74th
1212 Legislature, Regular Session, 1995, is amended by amending
1313 Subsections (a) and (f) and adding Subsection (a-1) to read as
1414 follows:
1515 (a) The district is managed by a board of three
1616 commissioners as provided by Chapter 56, Water Code, and each holds
1717 an elected office designated as Place No. 1, Place No. 2, or Place
1818 No. 3. The board shall call and hold elections for the appropriate
1919 number of commissioners on the uniform election date in May
2020 [November] of each [oven] odd-numbered year. The [Notwithstanding
2121 Section 56.063, Water Code, the] commissioners serve staggered
2222 four-year terms, each beginning June [January] 1 of the year
2323 [following] of the commissioner's election and continuing until the
2424 commissioner's successor in office is elected and has qualified.
2525 (a-1) If a commissioner announces the commissioner's
2626 candidacy, or in fact becomes a candidate, in any general, special,
2727 or primary election for any office of profit or trust under the laws
2828 of this State or the United States other than the office of
2929 commissioner for the district, at any time when the unexpired term
3030 of office then held shall exceed one year and 30 days, such
3131 announcement or candidacy shall constitute an automatic
3232 resignation of the office of the commissioner.
3333 (f) A vacancy in a commissioner's office or other board
3434 office shall be filled by appointment by the remaining
3535 commissioners if less than 290 days remain before the date of the
3636 next regular election of one or more commissioners. [If the
3737 commissioners do not agree on an appointment before the 61st day
3838 after the date the vacancy occurs, the commissioners shall call and
3939 hold a special election to fill the office before the 121st day
4040 after the date the vacancy occurs].
4141 SECTION 2. Sections 7(b), (c), (d), (e), and (i), Chapter
4242 991, Acts of the 74th Legislature, Regular Session, 1995, are
4343 repealed.
4444 SECTION 3. (a) The Brazoria Drainage District No. 4 shall
4545 hold the first election to elect commissioners for Place No. 1 and
4646 Place No. 2 as described by Section 7(a), Chapter 991, Acts of the
4747 74th Legislature, Regular Session, 1995, as amended by this Act, on
4848 the uniform election date in May 2029.
4949 (b) The Brazoria Drainage District No. 4 shall hold the
5050 first election to elect the commissioner for Place No. 3 as
5151 described by Section 7(a), Chapter 991, Acts of the 74th
5252 Legislature, Regular Session, 1995, as amended by this Act, on the
5353 uniform election date in May 2027.
5454 (c) The terms of the commissioners for Place No. 1 and Place
5555 No. 2 serving on the board of commissioners of the Brazoria
5656 Drainage District No. 4 on the effective date of this Act expire on
5757 the later of May 31, 2029, or the date the commissioners elected
5858 under Subsection (a) of this section have qualified.
5959 (d) The term of the commissioner for Place No. 3 serving on
6060 the board of commissioners of the Brazoria Drainage District No. 4
6161 immediately before the date of the election held under Subsection
6262 (b) of this section expires on the later of May 31, 2027, or the date
6363 the commissioner elected under that subsection has qualified.
6464 SECTION 4. (a) The legal notice of the intention to
6565 introduce this Act, setting forth the general substance of this
6666 Act, has been published as provided by law, and the notice and a
6767 copy of this Act have been furnished to all persons, agencies,
6868 officials, or entities to which they are required to be furnished
6969 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
7070 Government Code.
7171 (b) The governor, one of the required recipients, has
7272 submitted the notice and Act to the Texas Commission on
7373 Environmental Quality.
7474 (c) The Texas Commission on Environmental Quality has filed
7575 its recommendations relating to this Act with the governor, the
7676 lieutenant governor, and the speaker of the house of
7777 representatives within the required time.
7878 (d) All requirements of the constitution and laws of this
7979 state and the rules and procedures of the legislature with respect
8080 to the notice, introduction, and passage of this Act are fulfilled
8181 and accomplished.
8282 SECTION 5. This Act takes effect immediately if it receives
8383 a vote of two-thirds of all the members elected to each house, as
8484 provided by Section 39, Article III, Texas Constitution. If this
8585 Act does not receive the vote necessary for immediate effect, this
8686 Act takes effect September 1, 2025.
