7	7	AN ACT
8	8	relating to an optional procedure for the issuance of a permit by
9	9	City of Roma for the movement of oversize or overweight vehicles
10	10	carrying cargo in Starr County; authorizing a fee.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Chapter 623, Transportation Code, is amended by
13	13	adding Subchapter W to read as follows:
14	14	SUBCHAPTER W. STARR COUNTY PERMITS
15	15	Sec. 623.451. OPTIONAL PROCEDURE. This subchapter provides
16	16	an optional procedure for the issuance of a permit by the City of
17	17	Roma for the movement of oversize or overweight vehicles carrying
18	18	cargo on certain roadways located in Starr county.
19	19	Sec. 623.452. ISSUANCE OF PERMITS. (a) The commission may
20	20	authorize the City of Roma to issue permits for the movement of
21	21	oversize or overweight vehicles carrying cargo in Starr county on
22	22	the following roadways:
23	23	(1) Farm-to-Market Road 650 between its intersection
24	24	with River Road in Fronton and its intersection with U.S. Highway 83
25	25	in Roma;
26	26	(2) U.S. Highway 83 between its intersection with
27	27	Farm-to-Market Road 650 and its intersection with Franklin Avenue
28	28	in Roma;
29	29	(3) Bravo Boulevard in Roma between its easternmost
30	30	intersection with U.S. Highway 83 and the Roma-Ciudad Miguel Aleman
31	31	International Bridge;
32	32	(4) Franklin Avenue in Roma between the Roma-Ciudad
33	33	Miguel Aleman International Bridge and its easternmost
34	34	intersection with U.S. Highway 83;
35	35	Sec. 623.453. SURETY BOND. The commission may require the
36	36	City of Roma to execute, at its own expense, a surety bond payable
37	37	to the Texas Department of Transportation in an amount of not less
38	38	than $500,000 for costs of maintenance for the roadways described
39	39	by Section 623.452(a).
40	40	Sec. 623.454. PERMIT FEES. (a) The City of Roma may
41	41	collect a fee for permits issued under this subchapter. Except as
42	42	otherwise provided by this subsection, the maximum amount of the
43	43	fee may not exceed $200 per trip. On September 1 of each year, the
44	44	city may adjust the maximum fee amount as necessary to reflect the
45	45	percentage change during the preceding year in the Consumer Price
46	46	Index for All Urban Consumers (CPI-U), U.S. City Average, published
47	47	monthly by the United States Bureau of Labor Statistics or its
48	48	successor in function.
49	49	(b) Fees collected under Subsection (a) may be used only for
50	50	the operation and maintenance of the roadways described by or
51	51	designated under Section 623.452 and for the City of Roma's
52	52	administrative costs, which may not exceed 15 percent of the fees
53	53	collected.
54	54	(c) The distribution of the fees collected under Subsection
55	55	(a) less the City of Roma's administrative costs must be
56	56	distributed between the state and the city based on lane mile
57	57	calculations between on and off system roadways subject to this
58	58	subchapter. Lane mile calculations must be adjusted on a biannual
59	59	basis.
60	60	(d) The City of Roma shall send the state's portion of the
61	61	fees collected under Subsection (a) to the comptroller for deposit
62	62	to the credit of the state highway fund. Fees deposited in the
63	63	state highway fund under this section are exempt from the
64	64	application of Section 403.095, Government Code.
65	65	Sec. 623.455. PERMIT REQUIREMENTS. (a) A permit issued
66	66	under this subchapter must include:
67	67	(1) the name of the applicant;
68	68	(2) the date of issuance;
69	69	(3) the signature of the designated agent for the City
70	70	of Roma;
71	71	(4) a statement of the kind of cargo being
72	72	transported, the maximum weight and dimensions of the equipment,
73	73	and the kind and weight of each commodity to be transported;
74	74	(5) a statement:
75	75	(A) that the gross weight of the vehicle for
76	76	which a permit is issued may not exceed 125,000 pounds; and
77	77	(B) of any other condition on which the permit is
78	78	issued;
79	79	(6) a statement that the cargo may be transported in
80	80	Starr County only over the roadways described by or designated
81	81	under Section 623.452;
82	82	(7) a statement that the permit does not authorize the
83	83	transportation of the cargo on an interstate highway; and
84	84	(8) the location where the cargo was loaded.
85	85	(b) The City of Roma shall report to the department all
86	86	permits issued under this subchapter.
87	87	Sec. 623.456. TIME OF MOVEMENT. A permit issued under this
88	88	subchapter must specify the time during which movement authorized
89	89	by the permit is allowed.
90	90	Sec. 623.457. SPEED LIMIT. Movement authorized by a permit
91	91	issued under this subchapter may not exceed the posted speed limit
92	92	or 55 miles per hour, whichever is less. A violation of this
93	93	provision constitutes a moving violation.
94	94	Sec. 623.458. ENFORCEMENT. The Department of Public Safety
95	95	has authority to enforce this subchapter.
96	96	Sec. 623.459. PAVEMENT MANAGEMENT PLAN. The Texas
97	97	Department of Transportation shall create a pavement management
98	98	plan for the roadways described by Section 623.452(a).
99	99	Sec. 623.460. RULES. The commission may adopt rules
100	100	necessary to implement this subchapter.
101	101	SECTION 2. The City of Roma may adjust the maximum fee
102	102	amount as provided by Section 623.454, Transportation Code, as
103	103	added by this Act, beginning September 1, 2026.
104	104	SECTION 3. This Act takes effect September 1, 2025.
