88 relating to an optional procedure for the issuance of a permit by
99 City of Roma for the movement of oversize or overweight vehicles
1010 carrying cargo in Starr County; authorizing a fee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 623, Transportation Code, is amended by
1313 adding Subchapter W to read as follows:
1414 SUBCHAPTER W. STARR COUNTY PERMITS
1515 Sec. 623.451. OPTIONAL PROCEDURE. This subchapter provides
1616 an optional procedure for the issuance of a permit by the City of
1717 Roma for the movement of oversize or overweight vehicles carrying
1818 cargo on certain roadways located in Starr county.
1919 Sec. 623.452. ISSUANCE OF PERMITS. (a) The commission may
2020 authorize the City of Roma to issue permits for the movement of
2121 oversize or overweight vehicles carrying cargo in Starr county on
2222 the following roadways:
2323 (1) Farm-to-Market Road 650 between its intersection
2424 with River Road in Fronton and its intersection with U.S. Highway 83
2525 in Roma;
2626 (2) U.S. Highway 83 between its intersection with
2727 Farm-to-Market Road 650 and its intersection with Franklin Avenue
2828 in Roma;
2929 (3) Bravo Boulevard in Roma between its easternmost
3030 intersection with U.S. Highway 83 and the Roma-Ciudad Miguel Aleman
3131 International Bridge;
3232 (4) Franklin Avenue in Roma between the Roma-Ciudad
3333 Miguel Aleman International Bridge and its easternmost
3434 intersection with U.S. Highway 83;
3535 Sec. 623.453. SURETY BOND. The commission may require the
3636 City of Roma to execute, at its own expense, a surety bond payable
3737 to the Texas Department of Transportation in an amount of not less
3838 than $500,000 for costs of maintenance for the roadways described
3939 by Section 623.452(a).
4040 Sec. 623.454. PERMIT FEES. (a) The City of Roma may
4141 collect a fee for permits issued under this subchapter. Except as
4242 otherwise provided by this subsection, the maximum amount of the
4343 fee may not exceed $200 per trip. On September 1 of each year, the
4444 city may adjust the maximum fee amount as necessary to reflect the
4545 percentage change during the preceding year in the Consumer Price
4646 Index for All Urban Consumers (CPI-U), U.S. City Average, published
4747 monthly by the United States Bureau of Labor Statistics or its
4848 successor in function.
4949 (b) Fees collected under Subsection (a) may be used only for
5050 the operation and maintenance of the roadways described by or
5151 designated under Section 623.452 and for the City of Roma's
5252 administrative costs, which may not exceed 15 percent of the fees
5353 collected.
5454 (c) The distribution of the fees collected under Subsection
5555 (a) less the City of Roma's administrative costs must be
5656 distributed between the state and the city based on lane mile
5757 calculations between on and off system roadways subject to this
5858 subchapter. Lane mile calculations must be adjusted on a biannual
5959 basis.
6060 (d) The City of Roma shall send the state's portion of the
6161 fees collected under Subsection (a) to the comptroller for deposit
6262 to the credit of the state highway fund. Fees deposited in the
6363 state highway fund under this section are exempt from the
6464 application of Section 403.095, Government Code.
6565 Sec. 623.455. PERMIT REQUIREMENTS. (a) A permit issued
6666 under this subchapter must include:
6767 (1) the name of the applicant;
6868 (2) the date of issuance;
6969 (3) the signature of the designated agent for the City
7070 of Roma;
7171 (4) a statement of the kind of cargo being
7272 transported, the maximum weight and dimensions of the equipment,
7373 and the kind and weight of each commodity to be transported;
7474 (5) a statement:
7575 (A) that the gross weight of the vehicle for
7676 which a permit is issued may not exceed 125,000 pounds; and
7777 (B) of any other condition on which the permit is
7878 issued;
7979 (6) a statement that the cargo may be transported in
8080 Starr County only over the roadways described by or designated
8181 under Section 623.452;
8282 (7) a statement that the permit does not authorize the
8383 transportation of the cargo on an interstate highway; and
8484 (8) the location where the cargo was loaded.
8585 (b) The City of Roma shall report to the department all
8686 permits issued under this subchapter.
8787 Sec. 623.456. TIME OF MOVEMENT. A permit issued under this
8888 subchapter must specify the time during which movement authorized
8989 by the permit is allowed.
9090 Sec. 623.457. SPEED LIMIT. Movement authorized by a permit
9191 issued under this subchapter may not exceed the posted speed limit
9292 or 55 miles per hour, whichever is less. A violation of this
9393 provision constitutes a moving violation.
9494 Sec. 623.458. ENFORCEMENT. The Department of Public Safety
9595 has authority to enforce this subchapter.
9696 Sec. 623.459. PAVEMENT MANAGEMENT PLAN. The Texas
9797 Department of Transportation shall create a pavement management
9898 plan for the roadways described by Section 623.452(a).
9999 Sec. 623.460. RULES. The commission may adopt rules
100100 necessary to implement this subchapter.
101101 SECTION 2. The City of Roma may adjust the maximum fee
102102 amount as provided by Section 623.454, Transportation Code, as
103103 added by this Act, beginning September 1, 2026.
104104 SECTION 3. This Act takes effect September 1, 2025.
