| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Title 4, Civil Practice and Remedies Code, is |

| 13 | 13 | | amended by adding Chapter 100B to read as follows: |

| 14 | 14 | | CHAPTER 100B. LIABILITY FOR DISCRIMINATION |

| 15 | 15 | | Sec. 100B.001. LIABILITY FOR DISCRIMINATORY FALSE REPORTS |

| 16 | 16 | | TO LAW ENFORCEMENT AGENCIES AND EMERGENCY SERVICE PROVIDERS. (a) A |

| 17 | 17 | | person who submits a false report to a law enforcement agency or |
|---|
| 18 | 18 | | emergency service provider, with the intent that the law |
|---|
| 19 | 19 | | enforcement agency or emergency service provider take action |
|---|
| 20 | 20 | | against a falsely accused person, is liable to the falsely accused |
|---|
| 21 | 21 | | person for an amount not to exceed $250 if the report was submitted |
|---|
| 22 | 22 | | due to bias or prejudice against the falsely accused person's race, |
|---|
| 23 | 23 | | color, disability, religion, national origin or ancestry, age, |
|---|
| 24 | 24 | | gender, sexual orientation, or gender identity. |
|---|
| 25 | 25 | | (b) If a falsely accused person prevails in an action |
|---|
| 26 | 26 | | brought under Subsection (a), the person may recover attorney's |
|---|
| 27 | 27 | | fees and costs incurred in bringing the action. |
|---|
| 28 | 28 | | SECTION 2. Section 100B.001, Civil Practice and Remedies |
|---|
| 29 | 29 | | Code, as added by this Act, applies only to a cause of action that |
|---|
| 30 | 30 | | accrues on or after the effective date of this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2025. |
