66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to affirmative defenses to prosecution for certain
99 criminal offenses involving material or conduct that may be obscene
1010 or is otherwise harmful to children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 43.25(f), Penal Code, is amended to read
1313 as follows:
1414 (f) It is an affirmative defense to a prosecution under this
1515 section that:
1616 (1) the defendant was the spouse of the child at the
1717 time of the offense; or
1818 (2) the conduct was for a bona fide educational,
1919 medical, psychological, psychiatric, judicial, law enforcement, or
2020 legislative purpose; or
2121 [(3)] the defendant is not more than two years older
2222 than the child.
2323 SECTION 2. Section 43.26(c), Penal Code, is amended to read
2424 as follows:
2525 (c) The affirmative defenses provided by Section
2626 43.25(f)(2) and (3) also apply to a prosecution under this
2727 section.] [It is an affirmative defense to a prosecution under this
2828 section that the possession or promotion was for a bona fide
2929 judicial, law enforcement or legislative purpose.]
3030 SECTION 3. Section 43.24(c), Penal Code, is repealed.
3131 SECTION 4. The changes in law made by this Act apply only to
3232 an offense committed on or after the effective date of this Act. An
3333 offense committed before the effective date of this Act is governed
3434 by the law in effect on the date the offense was committed, and the
3535 former law is continued in effect for that purpose. For purposes of
3636 this section, an offense was committed before the effective date of
3737 this Act if any element of the offense occurred before that date.
3838 SECTION 5. This Act takes effect September 1, 2025.
