77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of a work group to conduct a study on
1010 the feasibility of implementing an acute psychiatric bed registry.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. (a) In this section:
1313 (1) "Commission" means the Health and Human Services
1414 Commission.
1515 (2) "Executive commissioner" means the executive
1616 commissioner of the commission.
1717 (3) "Inpatient mental health facility" has the meaning
1818 assigned by Section 571.003, Health and Safety Code.
1919 (b) The commission shall establish a work group to conduct a
2020 study on the feasibility of implementing a statewide or regional
2121 acute psychiatric bed registry to list available beds at inpatient
2222 mental health facilities for the inpatient psychiatric treatment of
2323 certain individuals.
2424 (c) The work group consists of the following members
2525 appointed by the executive commissioner unless otherwise provided:
2626 (1) one member with appropriate expertise appointed by
2727 the governor;
2828 (2) two members with appropriate expertise appointed
2929 by the lieutenant governor;
3030 (3) two members with appropriate expertise appointed
3131 by the speaker of the house of representatives;
3232 (4) the chair of the Texas Hospital Association or the
3333 chair's designee;
3434 (5) the president of the Texas Medical Association or
3535 the president's designee;
3636 (6) the president of the Texas Nurses Association or
3737 the president's designee;
3838 (7) two members who are experts in the field of
3939 technology;
4040 (8) one member who is a licensed psychiatrist;
4141 (9) one member who is a licensed professional
4242 counselor, as defined by Section 503.002, Occupations Code;
4343 (10) one member who works in a substance use treatment
4444 facility;
4545 (11) one member who is a representative of a hospital
4646 located in a rural area of this state;
4747 (12) one member who is a representative of a hospital
4848 located in a county with a population of four million or more;
4949 (13) one member who is a representative of a hospital
5050 located in an urban area of this state in a county with a population
5151 of less than four million;
5252 (14) one member who is a representative of a public
5353 hospital;
5454 (15) one member who is a representative of a private
5555 hospital;
5656 (16) one member who is a statistician;
5757 (17) one member who is a public health expert; and
5858 (18) any other member with appropriate expertise as
5959 the executive commissioner determines necessary.
6060 (d) The work group shall elect from among the membership a
6161 presiding officer.
6262 (e) The work group shall meet periodically and at the call
6363 of the presiding officer.
6464 (f) Not later than September 1, 2026, the commission shall
6565 prepare and submit to each standing committee of the senate and
6666 house of representatives having primary jurisdiction over mental
6767 health a written report that summarizes the results of the study
6868 conducted under this section. The report must:
6969 (1) evaluate the effect of bed registries;
7070 (2) include recommendations for increasing public
7171 awareness of bed registries;
7272 (3) include recommendations for leveraging financial
7373 incentives and legislative, regulatory, or contractual mechanisms
7474 to expedite the entry of data for bed registries;
7575 (4) assess the effect of hospital reimbursements in
7676 increasing bed availability;
7777 (5) evaluate psychiatric treatment capacity in
7878 relation to bed availability; and
7979 (6) include any other information the commission
8080 considers necessary.
8181 (g) The work group is abolished and this section expires
8282 September 1, 2027.
8383 SECTION 2. As soon as practicable after the effective date
8484 of this Act, the applicable appointing authorities shall appoint
8585 the members to the work group established by this Act.
8686 SECTION 3. This Act takes effect September 1, 2025.
