9 | 9 | | relating to the establishment of a work group to conduct a study on |

10 | 10 | | the feasibility of implementing an acute psychiatric bed registry. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. (a) In this section: |
---|
13 | 13 | | (1) "Commission" means the Health and Human Services |
---|
14 | 14 | | Commission. |
---|
15 | 15 | | (2) "Executive commissioner" means the executive |
---|
16 | 16 | | commissioner of the commission. |
---|
17 | 17 | | (3) "Inpatient mental health facility" has the meaning |
---|
18 | 18 | | assigned by Section 571.003, Health and Safety Code. |
---|
19 | 19 | | (b) The commission shall establish a work group to conduct a |
---|
20 | 20 | | study on the feasibility of implementing a statewide or regional |
---|
21 | 21 | | acute psychiatric bed registry to list available beds at inpatient |
---|
22 | 22 | | mental health facilities for the inpatient psychiatric treatment of |
---|
23 | 23 | | certain individuals. |
---|
24 | 24 | | (c) The work group consists of the following members |
---|
25 | 25 | | appointed by the executive commissioner unless otherwise provided: |
---|
26 | 26 | | (1) one member with appropriate expertise appointed by |
---|
27 | 27 | | the governor; |
---|
28 | 28 | | (2) two members with appropriate expertise appointed |
---|
29 | 29 | | by the lieutenant governor; |
---|
30 | 30 | | (3) two members with appropriate expertise appointed |
---|
31 | 31 | | by the speaker of the house of representatives; |
---|
32 | 32 | | (4) the chair of the Texas Hospital Association or the |
---|
33 | 33 | | chair's designee; |
---|
34 | 34 | | (5) the president of the Texas Medical Association or |
---|
35 | 35 | | the president's designee; |
---|
36 | 36 | | (6) the president of the Texas Nurses Association or |
---|
37 | 37 | | the president's designee; |
---|
38 | 38 | | (7) two members who are experts in the field of |
---|
39 | 39 | | technology; |
---|
40 | 40 | | (8) one member who is a licensed psychiatrist; |
---|
41 | 41 | | (9) one member who is a licensed professional |
---|
42 | 42 | | counselor, as defined by Section 503.002, Occupations Code; |
---|
43 | 43 | | (10) one member who works in a substance use treatment |
---|
44 | 44 | | facility; |
---|
45 | 45 | | (11) one member who is a representative of a hospital |
---|
46 | 46 | | located in a rural area of this state; |
---|
47 | 47 | | (12) one member who is a representative of a hospital |
---|
48 | 48 | | located in a county with a population of four million or more; |
---|
49 | 49 | | (13) one member who is a representative of a hospital |
---|
50 | 50 | | located in an urban area of this state in a county with a population |
---|
51 | 51 | | of less than four million; |
---|
52 | 52 | | (14) one member who is a representative of a public |
---|
53 | 53 | | hospital; |
---|
54 | 54 | | (15) one member who is a representative of a private |
---|
55 | 55 | | hospital; |
---|
56 | 56 | | (16) one member who is a statistician; |
---|
57 | 57 | | (17) one member who is a public health expert; and |
---|
58 | 58 | | (18) any other member with appropriate expertise as |
---|
59 | 59 | | the executive commissioner determines necessary. |
---|
60 | 60 | | (d) The work group shall elect from among the membership a |
---|
61 | 61 | | presiding officer. |
---|
62 | 62 | | (e) The work group shall meet periodically and at the call |
---|
63 | 63 | | of the presiding officer. |
---|
64 | 64 | | (f) Not later than September 1, 2026, the commission shall |
---|
65 | 65 | | prepare and submit to each standing committee of the senate and |
---|
66 | 66 | | house of representatives having primary jurisdiction over mental |
---|
67 | 67 | | health a written report that summarizes the results of the study |
---|
68 | 68 | | conducted under this section. The report must: |
---|
69 | 69 | | (1) evaluate the effect of bed registries; |
---|
70 | 70 | | (2) include recommendations for increasing public |
---|
71 | 71 | | awareness of bed registries; |
---|
72 | 72 | | (3) include recommendations for leveraging financial |
---|
73 | 73 | | incentives and legislative, regulatory, or contractual mechanisms |
---|
74 | 74 | | to expedite the entry of data for bed registries; |
---|
75 | 75 | | (4) assess the effect of hospital reimbursements in |
---|
76 | 76 | | increasing bed availability; |
---|
77 | 77 | | (5) evaluate psychiatric treatment capacity in |
---|
78 | 78 | | relation to bed availability; and |
---|
79 | 79 | | (6) include any other information the commission |
---|
80 | 80 | | considers necessary. |
---|
81 | 81 | | (g) The work group is abolished and this section expires |
---|
82 | 82 | | September 1, 2027. |
---|
83 | 83 | | SECTION 2. As soon as practicable after the effective date |
---|
84 | 84 | | of this Act, the applicable appointing authorities shall appoint |
---|
85 | 85 | | the members to the work group established by this Act. |
---|
86 | 86 | | SECTION 3. This Act takes effect September 1, 2025. |
