88 AN ACT
99 relating to equitable operations policies for certain emergency
1010 homeless shelters.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 2306, Government Code, is
1313 amended by adding Section 2306.0945 to read as follows:
1414 Sec. 2306.0945. EMERGENCY HOMELESS SHELTER EQUITABLE
1515 OPERATIONS POLICIES. (a) This section applies only to an emergency
1616 homeless shelter that receives financial assistance administered
1717 by the department, including federal funds described by Section
1818 2306.094.
1919 (b) The department by rule shall require each emergency
2020 homeless shelter to adopt and implement equitable operations
2121 policies designed to ensure that individuals experiencing
2222 homelessness in this state have equal access to shelter and support
2323 services regardless of the individuals' race, ethnicity, national
2424 origin, gender identity, sexual orientation, age, religion,
2525 disability, or other protected status.
2626 (c) The equitable operations policies must require an
2727 emergency homeless shelter to:
2828 (1) eliminate discriminatory practices in the
2929 admission of individuals to and the discharge of individuals from
3030 the shelter and in the provision of services;
3131 (2) offer culturally and linguistically appropriate
3232 services and accommodations;
3333 (3) ensure that each individual receiving services
3434 from the shelter has access to the same level of basic amenities,
3535 such as clean and safe sleeping accommodations, showers, restrooms,
3636 and laundry facilities;
3737 (4) provide individuals receiving services from the
3838 shelter with access to supportive services, such as case
3939 management, employment assistance, health care, and mental health
4040 and substance use treatment;
4141 (5) prioritize the needs of individuals who are most
4242 vulnerable, including families with children, pregnant
4343 individuals, individuals with disabilities, and survivors of
4444 domestic violence;
4545 (6) adopt trauma-informed care practices to ensure
4646 that each individual receiving services from the shelter is treated
4747 with dignity and respect;
4848 (7) provide staff training and professional
4949 development on issues related to equity, diversity, and inclusion;
5050 (8) establish and implement other holistic operations
5151 policies determined by the department to maximize the opportunity
5252 for stabilization of the community the shelter serves during and
5353 after a public emergency; and
5454 (9) collect and report data to the department in
5555 accordance with department rule on the demographic characteristics
5656 of shelter residents and outcomes achieved.
5757 (d) The department shall develop and distribute to each
5858 emergency shelter guidelines and best practices for the adoption
5959 and implementation of the equitable operations policies.
6060 (e) The department shall monitor emergency homeless
6161 shelters to ensure compliance with this section.
6262 (f) The department may not provide financial assistance to
6363 an emergency shelter that fails to adopt and implement the
6464 equitable operations policies required by this section.
6565 (g) The department may collaborate with local emergency
6666 homeless shelter regulatory authorities in carrying out this
6767 section.
6868 (h) The senate finance committee and the house
6969 appropriations committee shall use the equitable operations
7070 policies required by this section as a guide in determining the
7171 costs and funding sources of those policies.
7272 SECTION 2. As soon as practicable after the effective date
7373 of this Act, the Texas Department of Housing and Community Affairs
7474 shall adopt the rules required by Section 2306.0945, Government
7575 Code, as added by this Act.
7676 SECTION 3. This Act takes effect September 1, 2025.
