77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation of roadside vendors and solicitors in
1010 certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 285.001(a) and (b), Transportation
1313 Code, are amended to read as follows:
1414 (a) To promote the public safety, the commissioners court of
1515 a county with a population of more than 500,000 [1.3 million] by
1616 order may regulate the following in the unincorporated area of the
1717 county if they occur on a public highway or road, in the
1818 right-of-way of a public highway or road, or in a parking lot:
1919 (1) the sale of items by a vendor of food or
2020 merchandise, including live animals;
2121 (2) the erection, maintenance, or placement of a
2222 structure by a vendor of food or merchandise, including live
2323 animals; and
2424 (3) the solicitation of money.
2525 (b) The commissioners court of a county with a population of
2626 more than 200,000 [870,000] that borders the United Mexican States
2727 by order may regulate the activities described by Subsection (a) in
2828 the manner described by that subsection, except that[:
2929 [(1) the regulation of activities on or in the
3030 right-of-way of a public highway or road is limited to public
3131 highways and roads with a speed limit of 40 miles per hour or
3232 faster; and
3333 [(2)] the county may not prohibit the sale of
3434 livestock.
3535 SECTION 2. This Act takes effect September 1, 2025.
