7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the regulation of roadside vendors and solicitors in
10	10	certain counties.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Sections 285.001(a) and (b), Transportation
13	13	Code, are amended to read as follows:
14	14	(a) To promote the public safety, the commissioners court of
15	15	a county with a population of more than 500,000 [1.3 million] by
16	16	order may regulate the following in the unincorporated area of the
17	17	county if they occur on a public highway or road, in the
18	18	right-of-way of a public highway or road, or in a parking lot:
19	19	(1) the sale of items by a vendor of food or
20	20	merchandise, including live animals;
21	21	(2) the erection, maintenance, or placement of a
22	22	structure by a vendor of food or merchandise, including live
23	23	animals; and
24	24	(3) the solicitation of money.
25	25	(b) The commissioners court of a county with a population of
26	26	more than 200,000 [870,000] that borders the United Mexican States
27	27	by order may regulate the activities described by Subsection (a) in
28	28	the manner described by that subsection, except that[:
29	29	[(1) the regulation of activities on or in the
30	30	right-of-way of a public highway or road is limited to public
31	31	highways and roads with a speed limit of 40 miles per hour or
32	32	faster; and
33	33	[(2)] the county may not prohibit the sale of
34	34	livestock.
35	35	SECTION 2. This Act takes effect September 1, 2025.
