77 AN ACT
88 relating to prohibiting the use of credit scoring in certain lines
99 of personal insurance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 559.001(2), (4), and (7), Insurance
1212 Code, are amended to read as follows:
1313 (2) "Agent" means a person licensed or required to be
1414 licensed as a [general] property and casualty insurance agent [or a
1515 personal lines property and casualty agent] under Subchapter B, C,
1616 or E, Chapter 4051.
1717 (4) "Consumer" means an individual whose credit
1818 information has been reported to or is in the possession of a
1919 consumer reporting agency or an insurer [is used or whose credit
2020 score is computed in the underwriting or rating of a personal
2121 insurance policy]. The term includes an applicant for insurance
2222 coverage.
2323 (7) "Credit report" means any written, oral, or other
2424 communication of information by a consumer reporting agency that[:
2525 [(A)] bears on a consumer's creditworthiness,
2626 credit standing, or credit capacity[; and
2727 [(B) is used or expected to be used or collected
2828 in whole or in part to serve as a factor to determine personal
2929 insurance premiums, eligibility for coverage, or tier placement].
3030 SECTION 2. Section 559.002, Insurance Code, is amended to
3131 read as follows:
3232 Sec. 559.002. APPLICABILITY OF CHAPTER. This chapter
3333 applies to each [an] insurer that writes personal insurance
3434 coverage [and uses credit information or credit reports for the
3535 underwriting or rating of that coverage].
3636 SECTION 3. Section 559.052, Insurance Code, is amended to
3737 read as follows:
3838 Sec. 559.052. [PROHIBITED] USE OF CREDIT INFORMATION
3939 PROHIBITED. (a) An insurer may not:
4040 (1) use an underwriting guideline [a credit score]
4141 that is based wholly or partly on the credit information, credit
4242 report, or credit score of an applicant for insurance coverage or
4343 any person other than the applicant who would be insured under a
4444 policy of personal insurance [computed using factors that
4545 constitute unfair discrimination];
4646 (2) refuse to underwrite or [deny,] cancel[,] or
4747 nonrenew a policy of personal insurance based wholly or partly
4848 [solely] on the [basis of] credit information, credit report, or
4949 credit score of an applicant for insurance coverage or any person
5050 other than the applicant who would be insured under the policy
5151 [without considering any other applicable underwriting factor
5252 independent of credit information]; [or]
5353 (3) take an action that results in an adverse effect
5454 against a consumer because the consumer does not have a credit card
5555 account;
5656 (4) charge an applicant for insurance coverage a
5757 higher premium than otherwise would be charged based wholly or
5858 partly on the credit information, credit report, or credit score of
5959 the applicant or any person other than the applicant who would be
6060 insured under a policy of personal insurance;
6161 (5) rate a risk based wholly or partly on the credit
6262 information, credit report, or credit score of an applicant for
6363 insurance coverage or any person other than the applicant who would
6464 be insured under a policy of personal insurance, including:
6565 (A) providing or removing a discount;
6666 (B) assigning the applicant for insurance
6767 coverage to a rating tier; or
6868 (C) placing an applicant for insurance coverage
6969 with an affiliated company [without considering any other
7070 applicable factor independent of credit information]; or
7171 (6) require a particular payment plan based wholly or
7272 partly on the credit information, credit report, or credit score of
7373 the applicant for insurance coverage or any person other than the
7474 applicant who would be insured under a policy of personal
7575 insurance.
7676 (b) An insurer may not consider an absence of credit
7777 information or an inability to determine credit information for an
7878 applicant for insurance coverage or for an insured as a factor in
7979 underwriting or rating an insurance policy [unless the insurer:
8080 [(1) has statistical, actuarial, or reasonable
8181 underwriting information that:
8282 [(A) is reasonably related to actual or
8383 anticipated loss experience; and
8484 [(B) shows that the absence of credit information
8585 could result in actual or anticipated loss differences;
8686 [(2) treats the consumer as if the applicant for
8787 insurance coverage or insured had neutral credit information, as
8888 defined by the insurer; or
8989 [(3) excludes the use of credit information as a
9090 factor in underwriting and uses only other underwriting criteria].
9191 SECTION 4. Section 559.055, Insurance Code, is amended by
9292 adding Subsection (c) to read as follows:
9393 (c) This section expires September 1, 2026.
9494 SECTION 5. The following laws are repealed:
9595 (1) Section 559.004(b), Insurance Code;
9696 (2) Sections 559.003, 559.051, 559.053, 559.054, and
9797 559.056, Insurance Code; and
9898 (3) Subchapters C and D, Chapter 559, Insurance Code.
9999 SECTION 6. (a) The changes in law made by this Act apply
100100 only to a personal insurance policy:
101101 (1) that is delivered, issued for delivery, or renewed
102102 on or after January 1, 2026;
103103 (2) the application for which is submitted on or after
104104 January 1, 2026; or
105105 (3) that is subject to determination of refusal to
106106 underwrite, cancellation, or nonrenewal on or after January 1,
107107 2026.
108108 (b) A personal insurance policy delivered, issued for
109109 delivery, or renewed before January 1, 2026, or the application for
110110 which is submitted before January 1, 2026, is governed by the law as
111111 it existed immediately before January 1, 2026, and that law is
112112 continued in effect for that purpose.
113113 SECTION 7. This Act takes effect September 1, 2025.
