77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the recusal of a member of the Railroad Commission of
1010 Texas in certain matters.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 81.01004, Natural Resources Code, is
1313 amended to read as follows:
1414 Sec. 81.01004. PERSONAL FINANCIAL DISCLOSURE, STANDARDS OF
1515 CONDUCT, [AND] CONFLICT OF INTEREST, AND RECUSAL. (a) A
1616 commissioner is subject to the provisions of Chapter 572,
1717 Government Code, that apply to elected officers, including the
1818 requirements governing personal financial statements, standards of
1919 conduct, and conflicts of interest.
2020 (b) Notwithstanding any other provision of law, a
2121 commissioner may not act on a matter under the commission's
2222 consideration that involves a business entity, as defined by
2323 Section 572.002, Government Code:
2424 (1) in which the commissioner has an equity ownership
2525 interest;
2626 (2) from which the commissioner receives income; or
2727 (3) with which the commissioner has otherwise done
2828 business in the preceding year in an amount of more than $5,000,
2929 including the making of consumer purchases.
3030 SECTION 2. This Act takes effect September 1, 2025.
